Drunk Driver Lies About Operating Vehicle During Head-on Crash with Injuries

Niagara Falls Police responded to 70th Street and Niagara Falls Boulevard around 6:45pm on October 12th after reports of a motor vehicle accident with injuries.
Upon arrival, officers observed a white chevy Silverado in the median lane with front end damage. There was also a red Chevrolet equinox in the westbound lane.
The driver of the equinox stated that he was slowing down in the median, facing westbound to make a left hand turn onto 70th Street from Niagara Falls Boulevard. The white truck was traveling eastbound and struck him head on.
The passenger in the equinox was seriously injured in the crash. According to AMR, she sustained a fracture to her right arm.
The driver and passenger in the equinox stated that a male wearing a green shirt – later identified as Jaxon Hoyt – was driving the truck.
Passengers in the truck originally stated that Hoyt was not the driver. However, they soon changed their story to admit that Hoyt was driving.
Officers began to interview Hoyt. He initially claimed to not be driving and then admitted shortly thereafter that he indeed was.
While speaking with him, officers observed glassy eyes, slurred speech, and an odor of fruity alcoholic beverage emanating from his person. Hoyt stated he had a “couple beers and a couple shots,” but wasn’t specific with the amount.
Hoyt failed all field sobriety testing. He was read his Miranda and DUI warnings at 7:11pm and placed under arrest. He was transported to police headquarters for booking and processing. He refused to take a chemical breath test.
