Crosswalk Violation Used as Pretext to Search Black Male, Possible Burglary Tools Found in Backpack


Niagara Falls Police were on routine patrol on the 2600 block of Main Street around 2am on July 12th attempting to locate an unknown suspect responsible for a string of burglaries in the area. While driving, officers observed an unknown male crossing over illegally to the west side of the street without using a designated crosswalk.



Officers were in close proximity to Deveaux Mini Mart which has previously been burglarized (see story here: https://www.niagaraaction.com/male-responsible-for-string-of-burglaries-in-niagara-falls-caught-on-camera). Officers attempted to make contact with the male after observing him commit the violation and announced themselves as “police” and to “stop.” The male continued to walk away and increased his pace.



Officers quickly caught up with the male and grabbed his arms. The male actively resisted by pulling away from officers. Officers also noted that the male appeared to be protecting/hiding his backpack, including one moment when the male placed his hands behind his back near a belt he was wearing. It was unclear at this time whether the male head a weapon.



The official incident report does not state how officers were able to subdue the male, but they were able to place him in handcuffs. The male was reluctant to give his name, but eventually did so. Officers searched the male and his backpack “incident to arrest” as he had “obstructed officers upon initial approach.”



The male was found to be in possession of multiple burglary tools including two flashlights, a box cutter and a hatchet. The male did not answer any questions by law enforcement before he was transported to police headquarters for booking and processing.
