VIDEO: Body Camera Shows Upstate New York Man Point Gun at Troopers Before Fatal Shooting


Newly released body camera footage reveals an encounter outside a New York State Police barracks in Saratoga County where a 69-year-old man was fatally shot by troopers after allegedly pointing a gun at them.


According to the New York State Attorney General’s Office, which made the footage public on Thursday, the incident took place on April 9th in Malta, about 25 miles north of Albany. At approximately 1:43pm, David Levine of Malta reportedly approached the State Police facility and opened fire on the building with a long gun.



State Police spokesperson Stephanie O’Neil said officers inside the barracks quickly realized shots were being fired. The footage shows two troopers exiting the building through a side door as one says, “He’s still out front — I don’t know how to approach this.”


In the video, Levine can be seen in the parking lot near a red pickup truck, holding what appears to be a rifle. The troopers notify 911 dispatchers, giving a description of Levine’s appearance.


“He’s laying down,” one trooper notes, before the other officer moves toward his vehicle to retrieve a patrol rifle and take cover.



About two minutes into the footage, a trooper shouts commands at Levine, urging him to drop the weapon. Levine, now standing, responds, “No, shoot me.”


Despite repeated orders to disarm and get on the ground, Levine refused and raised his weapon in the direction of the officers.


One of the troopers then fired, striking Levine.



Officers immediately moved in, placed him in handcuffs, and called for emergency medical assistance. Levine was transported to a nearby hospital where he was pronounced dead.


The Office of the Attorney General, which is legally mandated to investigate deaths caused by law enforcement officers, responded to the scene and has launched an official investigation. The office has not yet issued a final determination on the case.



Levine’s motive is unknown and an investigation is ongoing.
