On Friday, November 15th, a female student at the school wrote the following message to Niagara Action. Although her identity is known to Niagara Action, we are not releasing that to the public. I am a student at Niagara Wheatfield High School and I'm in the senior class of 2025. The school does nothing about bullying, domestic violence, or sexual assault. I was sexually assaulted by another student and provided a restraining order. The school continued to put me in classes with said student, even when I had the restraining order. They also do nothing about bullying. I have been bullied for years on end and one of the assistant principals at the High School proceeded to put me on a bus that all of my bullies were on. My mom took me off of that bus, but they knew I was bullied by these people and I have had to call police to my bus stop in the past. Administration refuses to do anything about bullying or sexual assault. I have never felt safe at this school. I don't feel comfortable in this school. A history of major incidents can be found below: 2019 Incident A cell phone video captured Niagara Wheatfield eighth grader Duane Mays Jr. being harassed by classmates who mock his shirt and use racial slurs. Mays remained calm. His parents, Duane and Quatina Mays, were outraged that their son received an in-school suspension after the incident which occurred during lunch at Edward Town Middle School. They question the lack of adult supervision during the bullying and call for improved anti-bullying programs and better monitoring in schools. The school district acknowledged the video but stated they cannot comment further due to privacy laws, leaving the Mays family dissatisfied with the response. Further, many comments made on social media surrounding the video were parents stating that bullying is common throughout the district. Attorney General Lawsuit Against Niagara Wheatfield Central School District in 2021 New York Attorney General Letitia James recently won an appeal to continue her lawsuit against the Niagara Wheatfield Central School District alleging that the district ignored abuse, harassment, and bullying within its schools. The 2nd U.S. Circuit Court of Appeals reversed a previous ruling that dismissed the case for lack of standing and is allowing the lawsuit to proceed in federal court. Filed in June 2021, the lawsuit claims the district failed to provide a safe environment for students. It detailed incidents involving four students and citing over 30 other unspecified cases of sexual assault, harassment, and gender-based bullying. The appellate court's decision emphasized that the district's alleged inaction could have harmful effects on a significant portion of New York's population - leaving students feeling unprotected. The lawsuit outlines actual consequences of the district's negligence including a student's panic attack, another's years of counseling, a third student transferring to a private school, and a fourth dropping out entirely. Some contemplated suicide. One specific allegation noted that a cheerleading coach dismissed a student's absences by stating, "girls get assaulted all the time," highlighting the troubling culture within the school. Lawsuit by former student alleging school did not protect her from sexual harassment, bulling and intimidation after she was raped by a classmate A former Niagara-Wheatfield student filed a federal lawsuit against the Niagara-Wheatfield School District alleging that it failed to protect her from sexual harassment, bullying, and intimidation after she was raped by a classmate in 2018. The lawsuit claims that the victim had to confront her rapist daily and endure ongoing discrimination and harassment which led to mental health issues. Despite Elias Dowdy, the offender, being sentenced to probation and the female student having an order of protection, the school allowed him to continue attending school - further subjecting the victim to harassment. The lawsuit asserts that the district did not take meaningful action to safeguard her from future harm. Letter from parents of female student in 2024 On October 29, 2024, it came to our attention that our daughter had become the victim of cyberbullying, which then followed her into school. We immediately notified the Niagara Wheatfield school district expecting quick action to protect her. Sadly, we were very wrong. When the mother of the bully was informed, her response was dismissive: “Your daughter is going to hear worse, especially since she’s chubby.” Rather than addressing this harmful behavior, the district’s response has been disturbingly inadequate. After days of waiting, on November 1st, 2024, the district finally responded to our repeated calls for them to do something to protect our daughter. They simply decided that the two students should “stay away from each other” and that there would no further communication from the school with the bully's mother due to her “hostile nature.” Yes, they actually said that the kids staying away from each other would solve the problem - as if they weren't already told the bullying started over social media. The district's response disregards the seriousness of the bullying and has only emboldened not only her bully, but others to join in and attack our daughter. What’s worse, the bully’s TikTok account is publicly accessible and has a pinned video that directly targets our daughter. The district has seen this video, yet claims they are powerless to act. Bullying today is different from when we were kids. Back then it largely stopped when you left school, but now with social media it follows children even into their homes making it impossible to escape. Our daughter, who once loved school, now dreads attending because of this relentless harassment. We refuse to let our child become another tragic statistic of bullying-related suicide. She deserves a safe, supportive environment, and we’re determined to stand up for her and for every child facing similar challenges. We are reaching out to our community for support to hold the Niagara Wheatfield school district accountable and demand meaningful action before this situation escalates further. A week ago, Niagara Action received information from a student at Niagara Wheatfield High School regarding an alleged violation of student rights. According to the male student, Niagara Wheatfield has severely limited access to bathrooms at the school. The original article can be read below. Since that article was posted, Niagara Wheatfield has adjusted their current policy - they now allow two male students in the bathroom at a time accompanied by law enforcement or another adult. Another student wrote to Niagara Action with an update on the situation: I am a senior at Niagara Wheatfield and I would like to update you guys on the bathroom situation since the article was posted. As a male, I feel deeply hurt that I'm not trusted to be in the bathroom by myself at school. I'm 17-years-old and can't handle using the urinal without a police escort? They watch us like we're 4. The bathroom situation is the same as previously reported apart from they now let more than one person in the bathroom. For instance, today I had to sign out of class, sign into the bathroom, wait for two individuals to exit, and then I was able to enter while being watched. There is the off-chance you get lucky enough to find a gender neutral bathroom that isn't being gaurded. I was in the science wing today and was going in the gender neutral bathroom when two cops walked passed me. I walked out four and a half minutes later to both cops standing directly outside the door to the bathroom waiting for me. ORIGINAL ARTICLE REGARDING BATHROOM CLAMPDOWN “I am a student at Niagara Wheatfield High School with a problem in school that is not being talked about,” said the student whose identity is being withheld. “I am in the senior class of ‘25 and I am a male student who is denied access to the bathroom due to the school closing the bathrooms and guarding them.” Of the nine male bathrooms throughout the school, only one is open. This bathroom is guarded by a police officer and involves a process to use. “You sign out on a sheet of paper in class, proceed to the bathroom and wait in a line, sign into the bathroom itself, have the guard follow you in as he watches you use the restroom, and then he escorts you out of the bathroom,” explained the student. “You then sign out and walk back to class and sign back in.” Niagara Action received a copy of an email that was sent by Niagara Wheatfield administration to students that contains an explanation for the drastic measures put in place. It says the following: “As you may have heard, there have been some poor choices being made by a small number of our male students, which is creating issues in our bathrooms. On top of vaping and vandalism, at least one student is responsible for spreading peanut butter on walls and sinks, which is incredibly dangerous, if not life threatening for some students. In order to maintain safe conditions for all of our students, we have limited the number of open bathrooms so we can monitor the physical environment. To be clear, no student has been denied bathroom access.” However, the student says that this is not only false but over dramatized. “The problem with the whole smoking thing is that our school is under construction,” claimed the student. “The school is covered in smog from all the construction and dust particles regardless of what they’re doing about the bathrooms. The peanut butter was actually a chocolate fudge stick with NO peanut butter. The ‘vandalism’ constituted juice cups that get left in there occasionally.” Niagara Wheatfield has been under tremendous pressure lately due to allegations of a continued failure to address issues of bullying, sexual assault and harassment. There is also no awareness being spread regarding drugs which is a serious issue as one of our students overdosed two years ago.” Students are suffering the consequences for the administration’s failures. “We have metal detectors and armed guards but no bathrooms without being watched by a cop. The North Tonawanda Police Department announced that several teenagers are facing charges related to a series of incidents that have occurred throughout the city in recent weeks. Investigators have identified a 14-year-old suspect linked to vandalism at the Deerwood Country Club on Sweeney Street. Police responded to reports of damage on October 26th where it was discovered that the teen had used a dirt bike to cause damage to the greens, fairways, and tee boxes. The bike was impounded and the teen received a fine for violating Niagara County's Off-Road Vehicle Law. Additionally, the teen has been charged with Criminal Mischief in the Second Degree and is currently reimbursing the City of North Tonawanda for the damages incurred. In a separate incident on October 27th, five individuals were identified in connection with the destruction of Halloween decorations across the city. Thanks to community assistance and social media efforts, police were able to pinpoint the suspects who have collectively paid over $4,000 in restitution for the damages. They are also required to appear in Niagara County Youth Court. The most recent incident occurred on November 10th when police responded to a report of an elderly man being assaulted at a McDonald's. Officers apprehended a 14 and 16-year-old involved in the assault. The 14-year-old received an appearance ticket as a juvenile delinquent and has been referred to Niagara County Probation while the 16-year-old was issued a ticket as an adolescent offender and will be referred to the Superior Court Youth Part. Both teens have been charged with Assault in the Second Degree. The U.S. Attorney’s Office announced that Michael Pryor, a 27-year-old member of a Niagara Falls Crips Gang, has been sentenced to three years in prison following his conviction on multiple drug charges. Pryor was found guilty of conspiracy to possess with intent to distribute cocaine and distribution of fentanyl within 1,000 feet of public housing. According to officials, he conspired with co-defendants Shawn Pryor, Cameron Lee, and others to facilitate the sale of cocaine. The U.S. Attorney’s Office noted that Michael, Shawn, and Lee were identified as members and associates of the Crips Gang, collaborating to sell drugs to one another as needed. The charges stemmed from an incident on October 7th, 2022, when Michael allegedly sold fentanyl to an undercover law enforcement officer near the Anthony Spallino Towers, which is managed by the Niagara Falls Municipal Housing Authority. He was also involved in selling cocaine, crack cocaine, and fentanyl to the officer and an informant working with law enforcement. In a separate incident on October 16th, 2022, Michael, Shawn, and another accomplice reportedly attacked a rival drug dealer at a convenience store on Ashland Avenue in Niagara Falls. A Niagara Falls Police officer was working security for Walmart around 4:30pm on November 7th when he was alerted by asset protection of an internal investigation into an employee. Asset protection stated that over a one-month period a male employee was observed on nine separate occasions selecting items from store shelving and consuming the items, which included both beverages and food. He failed to pay for any of the consumed items and was captured on security cameras each time. Today, the male employee was brought into the main office for an interview. He admitted to the thefts - totaling $26.30 - and was given an appearance ticket for petit larceny. It was not mentioned whether the employee was fired, but it is likely he was. No further information is available at this time. Walmart Employee Arrested for Consuming Food and Beverages from Shelves

A Niagara Falls Police officer was working security for Walmart around 3:45pm on November 7th when he was alerted by asset protection of a shoplifting in progress. Asset protection advised the officer that a black male had pushed a shopping cart full of groceries through and unmanned register and was heading toward the home and living exit. The male did push the cart passed all points of purchase without rendering payment. The officer and asset protection confronted the man at the exit where he was detained and escorted to the security office. The male was arrested and issued an appearance ticket returnable at Niagara Falls City Court. The cart contained 58 items totaling $580.66. No further information is available at this time. Shoplifting Suspect Caught after Going through Unmanned Register Line

Superintendent of Starpoint Central School District Sean Croft made his first appearance before staff and parents on Monday night since his DWI arrest in August. This marked his first school board meeting following his reinstatement, which was supported unanimously by the board earlier this month. In September, Croft pleaded not guilty to charges stemming from an incident where he allegedly crashed into a tree on Nina Terrace in West Seneca exhibiting signs of intoxication and failing field sobriety tests. Croft reflected on the challenges he has faced and emphasized the importance of how one responds to obstacles, whether they are self-imposed or external. He was placed on administrative leave after the incident and, when asked about the ongoing legal matters, opted not to comment, stating that his priority is to reconnect with the Starpoint community and lead the district. The school board's decision to reinstate Croft acknowledged both the seriousness of the incident and his long-standing commitment to the district. As part of Croft's reinstatement, he has signed a new contract that reduces his employment term by one year and includes no salary increases. He is also required to undergo drug and alcohol testing if there are suspicions of impairment and faces termination if he is arrested again. James Reed, 42, was sentenced to 166 months in federal prison—nearly 14 years—on Monday for his involvement in a gruesome triple murder and subsequent cover-up. The case gained notoriety for the tragic circumstances surrounding a 3-year-old who was left alone in a minivan with his dead parents. Reed's day began innocuously on September 15th, 2019, as he drove a cab attempting to distance himself from the drug trade that had defined much of his life. However, by late afternoon, he found himself at the center of a violent crime scene at 4 Roebling Ave. in the Schiller Park neighborhood. Reed had intended to simply count money related to a drug deal involving his brother, Jariel Cobb, and Deandre Wilson, who were expecting a shipment of cocaine from Florida. The situation escalated when Wilson fatally shot Dhamyl Roman-Audiffred in the kitchen. He then stepped outside and shot Miguel Anthony Valentin-Colon and his wife, Nicole Marie Merced-Plaud, who were waiting in a minivan with their son, Noelvin. Reed claimed he had no foreknowledge of the impending violence, stating, "I'm not a saint, but I'm not a violent person. I didn't have no insight into what was going to happen." In the aftermath of the murders, Reed and Cobb moved Roman-Audiffred's body to the basement, where Cobb dismembered it using an ax and other tools. The story of Saniyya Dennis, a 19-year-old Buffalo State College student who went missing on April 24th, 2021, is heartbreaking. Evidence released by law enforcement suggested Dennis took her own life after a series of distressing events leading up to her disappearance. Until this week, there had been no confirmation of whether Dennis' body was recovered despite extensive search efforts. Niagara Action can confirm that Dennis' head was recovered from the lower Niagara River in the weeks after her tragic death. The source, a male who was working rescue efforts at the Maid of the Mist, said that the remains were found floating in the water. New York State Police were contacted for comment and stated that the investigation was handed back to SUNY Buffalo State: " NYSP documents a New York State Park Police case regarding that subject, Saniyya Dennis that SP Niagara Bureau Criminal of Investigation turned over to SUNY Buffalo State College as a missing person case." Niagara Action reached out to SUNY Buffalo State University who have not returned multiple requests for comment. Dennis was last seen leaving her dormitory on the evening of April 24th following an argument with her boyfriend that resulted in their breakup. In the hours that followed, she made numerous attempts to contact him calling 66 times and sending alarming texts including one that read, "I’m not feeling good - I think I’m going to kill myself." Despite her desperate pleas, her ex-boyfriend, who was in New York City at the time, did not respond. Later that day, Dennis spoke with a male friend in New York City confiding in him about her suicidal thoughts. They engaged in a four-hour conversation during which she expressed feelings of hopelessness but also mentioned reconsidering her earlier statements about suicide. However, around 11pm, she was seen on surveillance footage throwing personal items into a garbage can which lead investigators to believe she had decided not to return to her dorm. Shortly after discarding her belongings, Dennis swiped her bus card and traveled alone to Goat Island, a location near Niagara Falls. Around midnight, she sent a text to her mother saying, "I love you - I’ll call tomorrow," and another to her friend indicating she wouldn’t see him that summer. The last confirmed sighting of Dennis was captured on park cameras around 12:17am on April 25th where she was seen on a bridge. During a 45-minute phone call with her male friend, she disclosed her intention to jump off the bridge. Just after 1am, she took a Snapchat selfie with the iconic falls in the background. Minutes later, she sent a final text to a friend claiming she was on her way back to Buffalo, but cell phone records later indicated this was not true. Shortly afterward her phone left the cellular network, suggesting it was either turned off or destroyed. A K9 search tracked Dennis's scent to Luna Island, located between the American Falls and Bridal Veil Falls, where the dogs showed signs of wanting to jump over a railing into the turbulent waters below. Despite her desperate pleas, her ex-boyfriend, who was in New York City at the time, did not respond. Later that day, Dennis spoke with a male friend in New York City confiding in him about her suicidal thoughts. They engaged in a four-hour conversation during which she expressed feelings of hopelessness but also mentioned reconsidering her earlier statements about suicide. However, around 11pm, she was seen on surveillance footage throwing personal items into a garbage can which lead investigators to believe she had decided not to return to her dorm. Shortly after discarding her belongings, Dennis swiped her bus card and traveled alone to Goat Island, a location near Niagara Falls. Around midnight, she sent a text to her mother saying, "I love you - I’ll call tomorrow," and another to her friend indicating she wouldn’t see him that summer. The last confirmed sighting of Dennis was captured on park cameras around 12:17am on April 25th where she was seen on a bridge. During a 45-minute phone call with her male friend, she disclosed her intention to jump off the bridge. Just after 1am, she took a Snapchat selfie with the iconic falls in the background. Minutes later, she sent a final text to a friend claiming she was on her way back to Buffalo, but cell phone records later indicated this was not true. Shortly afterward her phone left the cellular network, suggesting it was either turned off or destroyed. A K9 search tracked Dennis's scent to Luna Island, located between the American Falls and Bridal Veil Falls, where the dogs showed signs of wanting to jump over a railing into the turbulent waters below. According to the male student, Niagara Wheatfield has severely limited access to bathrooms at the school. “I am a student at Niagara Wheatfield High School with a problem in school that is not being talked about,” said the student whose identity is being withheld. “I am in the senior class of ‘25 and I am a male student who is denied access to the bathroom due to the school closing the bathrooms and guarding them.” Of the nine male bathrooms throughout the school, only one is open. This bathroom is guarded by a police officer and involves a process to use. “You sign out on a sheet of paper in class, proceed to the bathroom and wait in a line, sign into the bathroom itself, have the guard follow you in as he watches you use the restroom, and then he escorts you out of the bathroom,” explained the student. “You then sign out and walk back to class and sign back in.” Niagara Action received a copy of an email that was sent by Niagara Wheatfield administration to students that contains an explanation for the drastic measures put in place. It says the following: “As you may have heard, there have been some poor choices being made by a small number of our male students, which is creating issues in our bathrooms. On top of vaping and vandalism, at least one student is responsible for spreading peanut butter on walls and sinks, which is incredibly dangerous, if not life threatening for some students. In order to maintain safe conditions for all of our students, we have limited the number of open bathrooms so we can monitor the physical environment. To be clear, no student has been denied bathroom access.” However, the student says that this is not only false but over dramatized. “The problem with the whole smoking thing is that our school is under construction,” claimed the student. “The school is covered in smog from all the construction and dust particles regardless of what they’re doing about the bathrooms. The investigation of a fatal hit-and-run incident that occurred on October 15th on Hyde Park Boulevard in Niagara Falls has resulted in an arrest. 19-year-old Patrick J. Washington III of Buffalo, NY, Incas arrested in connection with the tragic event. An altercation involving multiple individuals took place near 287 Hyde Park Boulevard, resulting in the victim being struck. Niagara Falls Police arrived at the scene around 2:30am and discovered an unresponsive male lying in the street. Medical personnel pronounced him dead shortly thereafter. The vehicle responsible for hitting the victim had already left the scene. The vehicle was found unoccupied in a nearby alley. At approximately 7pm on November 13th, members of the U.S. Marshals Fugitive Task Force located Washington and took him into custody. Upon arrival, officers spoke with an employee who stated he observed a female place two bottles of liquor in her purse and pass all points of purchase without rendering payment. The combined value of both bottles is $171.98. Officers apprehended the woman and returned her to the store where she was positively identified. Both bottles were returned for resale. He left Family Dollar and was walking on foot towards Elmwood Avenue. The suspect was observed stealing tide pods, canned goods and dish detergent from the store totaling $19.50. Officers canvassed the area and observed an individual matching the description. They made contact with the male who was detained without incident. He started dropping the stolen items on the ground as officers approached. The male was placed in the rear of a patrol vehicle and transported back to Family Dollar for a show up. Niagara Falls Police responded to the 8500 block of Niagara Falls Boulevard, in the area outside of Tim Hortons, around 4:45pm on November 9th after observing an unknown male walking in traffic. The male was acting erratically and yelling at cars driving by. While officers watched, he entered the Tim Hortons parking lot and began yelling and swearing at customers. Officers pulled into the lot and told the male to stop. He responded, “fuc* you. I don’t have to stop,” and started to walk away. Officers then exited the patrol vehicle and told the male he was being detained, to which he said, “I don’t have to stop. I didn’t assault anybody boy.” He was placed in handcuffs and made several “racial remarks” while a pat down was being conducted. Witnesses told police that the male had been walking back and forth yelling and screaming for about two hours. One woman said that her children were afraid because the male was yelling, swearing and acting in an irate manner. The male failed to pay for the merchandise and passed all points of sale. The male was placed under arrest at the entrance of the vestibule. The total value of merchandise found on him was $39.49. The male was issued an appearance ticket returnable to Niagara Falls City Court for the shoplifting. A violent altercation at the Red Roof Inn in Amherst on Tuesday night resulted in a young girl being hospitalized and two adults sustaining injuries. According to authorities, a 2-year-old girl was stabbed during the fight and was subsequently transported to Oishei Children's Hospital for treatment of her injuries. A Hamburg man has been charged following a violent carjacking spree that resulted in the death of a pedestrian. Mark G. Whalen, 31, was arraigned in Tonawanda City Court after prosecutors from the Erie County District Attorney's Office filed multiple felony charges against him including second-degree manslaughter and leaving the scene of an incident resulting in death. The series of events began in Evans with a hit-and-run incident and escalated as Whalen struck another vehicle on Church Street in Buffalo. The spree culminated in a tragic hit-and-run in the City of Tonawanda where Whalen fatally struck a 40-year-old man. Following this incident, he reportedly carjacked a vehicle in the Town of Tonawanda before being apprehended after colliding with another vehicle in North Tonawanda. In addition to the manslaughter charge, Whalen faces charges of third-degree grand larceny, second-degree reckless endangerment, third-degree unauthorized use of a motor vehicle, seventh-degree criminal possession of a controlled substance, third-degree aggravated unlicensed operation of a motor vehicle, and reckless driving, all misdemeanors. A Budapest court has ordered that the alleged murderer of Mackenzie Michalski, a native of Fredonia, NY, remain in custody following his confession to the crime. The 37-year-old suspect, identified by the initials L.T.M., was detained two days after Michalski was reported missing on November 7th. Michalski, who had been living in Portland, Oregon, was last seen on November 5th at a nightclub in central Budapest during her visit as a tourist. A tour bus filled with tourists and other passengers on their way to Niagara Falls crashed early Thursday morning leaving 28 people injured. Occupants were quickly transported to four local hospitals for treatment. 16 patients were admitted to Strong Memorial Hospital with one in critical condition and several others suffering from serious injuries. Another 15 patients were treated at Unity and Rochester General Hospital with three being transferred to Strong for further care. A tour bus carrying nearly 30 passengers from New York City to Niagara Falls overturned on Thursday morning resulting in multiple injuries. The incident occurred around 7:10am in Chili, NY, shortly after the bus had dropped off some passengers in Rochester. According to Monroe County Sheriff Todd Baxter, the bus was transporting 27 adults and one child when it lost control on the highway. First responders arrived on the scene to find victims staggering across the roadway “in a state of confusion” following the crash. Two individuals had to be extricated from the wreckage. A total of 28 people, including the bus driver, were hospitalized as a result of the accident with one individual continuing to be in critical condition. Sheriff Baxter described the scene as “surreal,” noting that it was a situation they had trained for but never expected to witness in real life. The crash is currently under investigation as a criminal matter although authorities clarified that this does not imply any criminal wrongdoing. A hunting accident has resulted in the death of Mark P. Scanlon, a 54-year-old Buffalo man and the older brother of acting Buffalo Mayor Chris Scanlon. New York State Police announced the incident on Thursday. State Police revealed that they responded to a welfare check call on Tuesday night after Mark did not return to his vehicle near Plato Road in East Otto. Upon investigation, authorities determined that Mark fell from a portable tree stand while hunting. Mark was not only a passionate outdoorsman but also a respected member of the Erie County Sheriff’s Department. Niagara Falls Police responded to the 2000 block of Pine Avenue around 9:30am on November 4th after reports of menacing with a weapon. Upon arrival, officers spoke to the complainant who stated that the suspect had come after him with an exhaust pipe. The suspect was supposed to be helping him clean the auto shop. However, the complainant found him sleeping and asked him to leave. It was then that he became irate. The suspect grabbed a metal pipe and started chasing the complainant around the parking lot, threatening to beat him with it. While this was going on, the complainant said he feared for his life. The complainant was able to call 911 and, when they arrived, the suspect was immediately detained. He was transported to police headquarters for booking and processing. While there, officers discovered multiple outstanding warrants out of Niagara Falls. He was held pending arraignment. No further information is available at this time.
