  • Niagara Falls Mayor Denies Targeting Black-Owned Businesses During Code Enforcement Checks

Niagara Falls Mayor Robert Restaino has addressed concerns raised by some Black business owners who believed they were targeted during recent code enforcement checks in the city. The mayor categorically denied any discriminatory intent, stating that the rules applied to all businesses equally. The Niagara Falls Code Enforcement department is responsible for various tasks including reviewing building plans, issuing work permits, and conducting building and site inspections. Earlier this month, several Black-owned businesses expressed their belief that they were singled out when they received cease-and-desist orders. In an interview with Channel 2's Nate Benson, Mayor Restaino responded to these allegations, emphasizing that no business was intentionally targeted. He expressed his inability to understand why such claims were made, reiterating that the rules and regulations were applied uniformly to all businesses. "I can't speak to why someone would say those things, but the rules are the rules for every business," Restaino stated. "And I will tell you this, that day or that span of days, we were out making sure that all businesses were properly licensed. Then, if you get onto a property that's not licensed, you then look and see that it's got all the necessary code enforcement requirements." The mayor's candid response aimed to reassure the community that the code enforcement checks were conducted in a fair and unbiased manner. He emphasized that the primary objective was to ensure compliance with licensing and code enforcement requirements, rather than targeting specific businesses based on their ownership. While some Black business owners may have felt targeted, Mayor Restaino's statement underscores the city's commitment to treating all businesses equally under the law. The Code Enforcement department's role is to uphold the regulations that promote safety and adherence to building codes, without any discriminatory intent.

  • Inmate Accused of Biting Off Tip of Officer's Finger in Attack at Correctional Facility

An inmate at the Collins Correctional Facility is facing serious charges after allegedly biting off the tip of an officer's finger and injuring several others during an attack on June 12th. The incident has raised concerns about the safety of correctional officers and the need for increased security measures within the facility. According to the New York State Correctional Officers & Police Benevolent Association (NYSCOPBA), the incident occurred when officers were conducting a routine cell search for contraband. The 28-year-old inmate was ordered out of his cell, but after the search was completed he allegedly refused to return to his cell. In response, three officers attempted to restrain him, resulting in a violent struggle. During the altercation, the inmate reportedly punched one officer in the face, bit off the tip of another officer's finger, and kicked a third officer in the groin. Additional staff members were called in to assist and eventually the inmate's arms were forced behind his back and handcuffs were applied. He was then escorted to a holding cell for evaluation. One of the officers was able to wrestle a pair of nail clippers out of the inmate's hand during the struggle, potentially preventing further harm. The officer who had his finger bitten off was immediately transported to Erie County Medical Center (ECMC) for further treatment, while the officer who was kicked in the groin was taken to a local urgent care facility. Both officers did not return to duty following the incident. Five other officers also sustained injuries during the attack but were able to continue their duties. The inmate involved in the alleged attack is currently serving a three-year sentence for second-degree assault. The incident has sparked discussions about the safety of correctional officers and the need for enhanced security protocols within the Collins Correctional Facility. The NYSCOPBA has called for a thorough investigation into the incident and is urging authorities to take appropriate action to ensure the safety of both officers and inmates. The organization believes that incidents like these highlight the dangerous nature of correctional work and the importance of providing adequate resources and support to those working in the field.

  • Woman Found Guilty of Second-Degree Murder of Unnamed Newborn Baby Boy

On Tuesday, June 18th, a found Andee R. Wright, from the Town of Tonawanda, guilty of second-degree murder in the death of her unnamed newborn baby boy in 2020. The verdict was delivered on the first day of deliberations with the jury reaching a decision in less than two hours. This was not the first trial for Wright as an earlier jury had deadlocked on the charges against her leading to a mistrial in December. However, the jury this time unanimously found her guilty of intentionally killing her newborn son, whom investigators named Baby Boy Wright. According to prosecutors, Wright gave birth to the child on a toilet in October 2020 and then proceeded to fracture his skull before placing him in a basement trash can. The baby was 38-weeks when born. The defense, on the other hand, argued that the baby was stillborn and that Wright, unaware of her pregnancy, panicked and disposed of the body after losing a significant amount of blood. Throughout the trial, both prosecutors and defense lawyers worked to discredit the testimony of medical experts. Prosecutors presented autopsy reports from the Erie County Medical Examiner's Office, which they claimed provided evidence that the baby had been born alive. The reports included microscopic images of expanded lung tissue, images of bleeding on the baby's brain, and apparent bruising and blood on the baby's head. Erie County Assistant District Attorney Rebecca Schnirel urged the jurors to examine these images and decide for themselves whether they saw signs of bruising and bleeding, which do not occur after death. Paul Dell, Wright's attorney, focused on the language used by prosecution experts claiming that it left room for doubt regarding their interpretations. He pointed out that the phrase "more likely than not" was used in the Medical Examiner's Office conclusions, suggesting uncertainty. Dell argued that the prosecution was asking the jurors to speculate and guess that these circumstances amounted to murder. Schnirel also sought to discredit the defense's medical experts, particularly Dr. Jane Turner, who testified that the baby likely died in utero. Schnirel pointed out inconsistencies in Turner's reports and characterized her answers as vague. During the trial, the prosecution emphasized Wright's drug and alcohol use around the time of the incident suggesting that it reflected her character as a bad mother. Dell dismissed this argument as speculative and urged the jurors to consider it as nothing more than background noise. Furthermore, Dell argued that this information was being brought up to do nothing more than prejudice Wright. In his closing statement, Dell reminded the jurors that only Wright knows exactly what happened that night and that she had told authorities the baby was not alive when he was born. He described the situation as a tragedy and warned against wrongfully convicting Andee Wright, which he believed would be another tragedy. Despite the defense's arguments, the jury ultimately found Wright guilty of second-degree murder. The verdict has left both the defense and Wright's attorney shocked, with Dell announcing plans to appeal the decision. The sentencing phase of the trial will now begin.

  • Authorities in Desperate Search for Lockport Mother Missing Almost a Month

Community members in Lockport, New York, are rallying together in their search for a missing mother. Sara Nicole Morningstar, who has been missing for almost a month, was last seen on May 24 at her home on East Avenue. On Saturday, volunteers organized a search party in hopes of finding any clues that could lead to her whereabouts. Sara and her husband, Lux Morningstar, operate a tattoo shop on the first floor of their home. Lux recalls that on the day she went missing, Sara mentioned she was going upstairs to put on her makeup. However, he later realized that she never returned. After reviewing surveillance footage, Lux discovered that Sara had left the house around 2:30 p.m., heading east on East Avenue, and possibly getting into a car. Both Lux and Sara's father have revealed that she has struggled with mental health issues in the past and has previously run away. However, this is the longest period of time she has been missing and there has been no activity on her social media accounts since her disappearance. Volunteers from the WNY Missing and Unidentified Persons Network joined the search efforts on Saturday. They plastered posters around the area and thoroughly combed through locations where Sara could potentially be, including the vicinity of train tracks and wooded areas. In heartfelt messages to Sara, both her husband and father expressed their concern and urged her to come home. Lux pleaded, "We're worried about you. We're all worried about you. Just pick up the phone and call and say I'm ok. You know, that's all you have to do." Similarly, her father emphasized the importance of her return, saying, "If someone does have her, bring her home. She needs to come back to her family. If she's out having fun, that's okay. We understand...we miss you, just come home safe, please." Lockport police have initiated an investigation into Sara's disappearance and have classified her as a "vulnerable adult." They are seeking the public's assistance in locating her as Sara's untreated mental health issues may pose a significant risk of harm to herself. Additionally, the volunteers involved in the search are urging anyone with security footage that may show Sara to provide it to the police. Anyone with information regarding Sara Morningstar's whereabouts is urged to contact Detective Lt. Steve Tarnowski at (716) 439-6718, the police dispatch at (716) 433-7700, or the police confidential tip line at (716) 439-6707.

  • Recovery of 19 Illegal Firearms in June Leads to 20 Local Arrests

In a commendable effort to combat gun violence, the Buffalo Police have made 20 arrests of individuals for illegal gun possession and recovered 19 firearms in the first two weeks of June. Buffalo Police Commissioner Joseph Gramaglia has highlighted the increase in the number of illegal guns recovered compared to the previous year, indicating a positive trend in the fight against gun-related crimes in 2024. The arrests were made as a result of various police operations including the execution of search warrants, SWAT team interventions, and routine traffic stops. Commissioner Gramaglia emphasized the importance of transparency, stating, "We want to get that information out to the public on the amount of guns that we're taking off the street and what happens to them at their court arraignment." Out of the 20 individuals arrested in June, 10 have posted bail, 5 have been remanded by the judge, and 5 have yet to post bail. Commissioner Gramaglia stressed the need for strict consequences for those illegally possessing firearms, stating, "If we're going to make a dent in violent crime, if we're going to make a dent in reducing our shootings, we need to be very heavy-handed with those that are illegally possessing guns, and that includes spending time in jail and staying in jail." The Buffalo Police Department's dedication to curbing gun violence is evident in their overall efforts. As of May, they have already recovered a total of 376 illegal guns indicating a significant increase compared to the previous three years. Commissioner Gramaglia acknowledged this progress, stating, "Looking overall at the last three years, year to date, we are up in the number of guns taken in." Notably, two of the firearms recovered during the June arrests were identified as "ghost guns," a term used to describe firearms that are assembled from parts and lack serial numbers. The Buffalo Police are actively addressing this concerning trend. Commissioner Gramaglia partially attributed the recent success in gun arrests to a state grant received by the Buffalo Police and other law enforcement agencies in Western New York. The Gun Involved Violence Elimination (GIVE) initiative provided a substantial funding of $6.4 million to agencies in Buffalo, Amherst, Cheektowaga, Lackawanna, and Erie County. This grant has enabled the Buffalo Police Department to allocate additional resources for overtime patrols, allowing officers to be more visible and engaged in the community. The Buffalo Police Department remains committed to ensuring the safety of the community by actively pursuing illegal gun possession and taking proactive measures to reduce gun-related crimes. The ongoing efforts, coupled with the support of the GIVE grant, are expected to have a significant impact on curbing gun violence in Buffalo and its surrounding areas.

  • Lawsuit Alleges Niagara Falls Industrial Plant Produced Radioactive Waste Leading to Lewiston Woman's Death

A Lewiston man has filed a lawsuit in Niagara County Supreme Court claiming that an industrial plant in Niagara Falls is responsible for producing radioactive waste that ultimately led to his wife's untimely death. The man's wife passed away from breast cancer two years ago and he believes that her exposure to the radioactive material caused her illness. The lawsuit specifically accuses NL Industries of dispersing radioactive material throughout Niagara County, posing a significant health risk to the community. Authorities involved in the case have made several startling discoveries finding radioactive materials beneath the man's concrete foundation and on his land, which is located on Upper Mountain Road. It is believed that this material was used as fill for driveways, foundations, roads, and yards in the area. During the investigation, items were found under the man's house that were directly linked to NL Industries, further supporting the claims made in the lawsuit. The Environmental Protection Agency (EPA) has been involved in assessing the situation and confirming the presence of radioactive materials. In an effort to address the issue, a $7 million excavation project was undertaken, resulting in the removal of 4,800 tons of radioactive soil from both the man's property and an adjacent property. This extensive cleanup was necessary to mitigate the potential health risks associated with the radioactive waste. According to the lawsuit, radiation levels confirmed by the EPA were found to be two to three times higher than background levels, with some areas exceeding 50 times the normal background radiation. These levels were also reported to be 50 to 100 times higher than the EPA's soil cleanup standard, which is based on a cancer risk of 1 in 10,000. The lawsuit seeks justice for the man's wife and holds NL Industries accountable for the alleged negligence in handling and disposing of radioactive waste. The case will now proceed in Niagara County Supreme Court where further investigations and legal proceedings will take place. We will follow any developments in the case and keep you informed.

  • Former Employee Pleads Guilty to Stealing Over $1 Million from Parish and Medical Office

A former employee at a local parish and a medical office has pleaded guilty and admitted to stealing over $1 million from the organizations. Lisa A. Noble, 44, also known as Lisa Prynn, pleaded guilty on Tuesday to the charges brought against her, according to the Erie County District Attorney's Office. Noble confessed to stealing approximately $465,000 from St. Amelia's Parish and over $500,000 from a City of Tonawanda audiology practice. The thefts occurred over a period of time with Noble making unauthorized purchases using St. Amelia's debit card, issuing fraudulent checks to herself, and stealing cash deposits while working as a business manager at the church from April to September last year. The stolen funds were allegedly used for personal expenses such as concert tickets, travel, and lodging. Noble even used around $20,000 of the stolen money to travel to Kansas City for a Taylor Swift concert, arriving in style in a limousine. Noble's actions came to light when she was placed on administrative leave by St. Amelia's Parish on September 15 after the theft was discovered. She was subsequently terminated from her position the following week. The embezzlement from the audiology practice took place from 2016 to 2021 while Noble worked there as an office manager. "This defendant brazenly stole nearly a million dollars from two former employers to fund her extravagant lifestyle then fled the area in an attempt to evade prosecution," said Acting Erie County District Attorney Mike Keane. "Today, I am pleased to announce that she has pleaded guilty to the indictment with a commitment from the judge that she will serve a significant period of incarceration." Noble pleaded guilty to multiple charges, including second-degree grand larceny, first-degree falsifying business records, third-degree grand larceny, and second-degree criminal possession of a forged instrument. As part of her plea agreement, Noble has signed confessions of judgment to pay restitution to both victims. She has been ordered to pay $465,424.19 to St. Amelia's Parish and $890,723.08 to the audiology practice. Noble now faces a maximum sentence of 30 years in prison. Her sentencing is scheduled for July 25, and she remains held without bail.

  • Noise Nightmare: North Tonawanda Residents Demand Action Against Digihost Crypto Company

Residents of North Tonawanda are facing sleepless nights and a decline in their quality of life due to persistent noise pollution caused by Digihost, a blockchain technology company specializing in crypto mining. The noise, believed to originate from the large fans used to cool down the bitcoin-mining computers in the company's buildings on Erie Avenue, has been a source of frustration for the community for over two years. The noise emitted by the Digihost facility is not only disruptive but also inconsistent, often becoming louder during the night. This constant disturbance has forced residents to close their windows on hot days, abandon their backyards, and even witness changes in their pets' behavior. Experts have warned that this noise pollution is likely detrimental to the health and well-being of the affected individuals. Despite numerous complaints from residents, the city of North Tonawanda has failed to take effective action to enforce its noise ordinance against Digihost. The ordinance is designed to protect the public health, comfort, convenience, safety, welfare, and prosperity of the community, including ensuring peace and quiet. City officials have cited a lack of equipment and resources as the reason for their inaction. Decibel level readings taken by the police department in May suggest that Digihost may have violated the noise ordinance. However, the city attorney, Edward Zebulske, recently explained that the equipment required for admissible evidence in court is expensive and necessitates specialized training. The absence of any meaningful measures to mitigate the noise pollution from the Digihost facility has left nearby residents vulnerable to potential health risks. In response, Digihost has applied for a permit to construct an acoustic barrier on their property, aiming to reduce the noise reaching neighboring homes. However, residents have expressed skepticism as a similar wall already in place has proven ineffective in dampening the sound. Noise pollution, even at levels that do not cause hearing loss, can have significant long-term consequences on health. The constant annoyance and disruption caused by the noise from the Digihost facility have been reported to disturb sleep and penetrate through walls and windows. This kind of stimulation can lead to various risk factors, including cardiovascular and mental health-related outcomes such as anxiety, depression, schizophrenia, immune response dysregulation, cardiovascular-related mortality, hypertension, and strokes. The residents of North Tonawanda are eagerly awaiting action from the city to address the noise pollution issue and protect their well-being. The enforcement of the noise ordinance and the implementation of effective measures by Digihost are crucial steps towards restoring peace and quiet in the community.
