Two individuals have been arrested and arraigned in connection with a series of thefts across Orleans and Niagara counties, including the theft of a trailer valued at over $102,000. Paul Rutherford Jr., 51, and Cori Rutherford, 27, were taken into custody following an investigation by the Orleans County Sheriff’s Office. The pair is accused of stealing a trailer from Lake Shore Metals in Ridgeway back in February. According to authorities, the duo transported the stolen trailer to North Carolina on the same day it was taken where they sold it for just $4,000. Investigators indicated that additional individuals were involved in the theft scheme, although their identities are currently being withheld as the investigation continues. In addition to the trailer theft, Paul Rutherford Jr. faces multiple charges related to other thefts, including the alleged theft of a farm truck from Root Brother’s Farm in Barre, another farm truck from the Town of Newfane, and various equipment such as diesel fuel, pumps, hoses, and a hydraulic hammer from Grow Mark FS Inc. in Ridgeway. In total, authorities estimate that Paul Rutherford has stolen approximately $200,000 worth of property since January leading to eight criminal cases against him with the potential for more charges to be filed. Paul Rutherford Jr. has been charged with two counts of second-degree grand larceny, two counts of third-degree grand larceny, third-degree burglary, and fourth-degree criminal mischief. He has posted bail and is currently released. Additionally, he faces grand larceny and criminal possession of stolen property charges in Niagara County. - Crash Leaves 23-Year-Old Dead, Toddler in Critical Condition
A horrific car accident on Monday night has resulted in the death of a 23-year-old man and left a 3-year-old girl in critical condition. The incident occurred around 9:40pm at the intersection of Sheridan Drive and Essjay Road. Authorities reported that the crash involved a Chevrolet Impala, driven by a 23-year-old man from Williamsville, who was traveling eastbound on Sheridan Drive. The vehicle was struck by a Honda CRV, operated by a 35-year-old man from Amherst, who was making a turn from westbound Sheridan onto southbound Essjay. The impact of the collision was severe, causing the Impala to burst into flames. Despite efforts by first responders, the 23-year-old driver was pronounced dead at the scene. The 3-year-old passenger in the Honda CRV sustained serious injuries and is now at Oishei Children’s Hospital where she is in critical but stable condition. The 35-year-old driver of the CRV was also taken to ECMC. His injuries are reported to be non-life threatening. - Alcoholic Sets House on Fire after Argument with Roommates
Niagara Falls Police responded to the 100 block of 70th Street around 8pm on September 20th after reports of a structure fire. Upon arrival, officers spoke to the complainants – a husband and wife – who stated their male roommate started a fire in the house and ran off. The female complainant stated that the roommate had been arguing with them all day long. He had moved in with them a few months ago, but was an alcoholic and always causing problems. During the incident tonight, the roommate became irate and yelled something along the lines of “watch what I do now.” He then went upstairs. The complainants heard a commotion and then observed him run down the stairs with a shirt over his nose. They began to smell smoke and then realized he had started a fire upstairs. Officers put a description of the male. Within a half hour, the roommate was apprehended and detained at a nearby 7-Eleven. The extent of damage to the home is not known at this time. - Witnesses Chase Vehicle After Woman Injured in Hit-and-run Incident
Niagara Falls Police responded to 47th and Niagara Falls Boulevard around 9pm on September 20th after reports that a pedestrian was hit by a vehicle. According to the 911 call, the woman was riding her bicycle at a crosswalk when she was struck. Prior to arrival, dispatch advised responding units that the striking vehicle was a blue Dodge Dakota and of its license plate number. Once on scene, officers observed a female lying on the street writhing in pain with obvious injuries to her leg and ankle. She was unable to describe what happened due to the pain she was in. Officers spoke to a husband and wife that were driving behind the Dodge Dakota on Niagara Falls Boulevard when the light at this intersection turned red. It was red for at least “seven seconds” when the Dodge Dakota traveled through it and struck the female victim on her bicycle. The striking vehicle then continued to drive away. The husband and wife then followed the vehicle to get the license plate number and were ultimately successful. The victim was transported by AMR to ECMC for treatment. Members of the crime scene unit responded to process the scene. Upon completion, officers relocated to ECMC where they learned the victim sustained a dislocated left ankle and a broken fibula in her left leg. There are no known suspects. - Man Admits Guilt in Sex Trafficking Minor to Pennsylvania
A 28-year-old man from Buffalo, Adrian Petty, pleaded guilty to charges related to the transportation of a minor for the purpose of engaging in sex trafficking. The plea was announced by the U.S. Attorney’s office on Thursday. The case dates back to September of 2020 when Petty transported a minor victim, whom he had met through Facebook, from New York to Pennsylvania to facilitate commercial sex acts. In addition to the transportation charge, Petty also confessed to advertising the minor online for sexual services. Petty pleaded guilty to interstate travel for purposes of prostitution. Niagara Falls Police responded to the 400 block of 18th Street around 3:30am on September 20th after reports of an assault. Upon arrival, officers made contact with a 56-year-old white male who was soaked in blood. The victim stated he was riding his bike in the area around 2:20am when two black males approached him. One of the males stated, “why you riding down our street?” The victim did not give a response and attempted to continue traveling down the block. However, he was blocked by the males who then started to attack him. He was punched several times in the face and body. Then, without warning, he was struck by one of the males with a hard object to his face and back of his head. The unknown object caused significant bleeding. The victim was unable to tell police what the object was. He did not know who the two males were and was unable to remember a physical description – possibly due to a concussion. In addition to the assault, the male suspects stole his silver BMX bike valued at $100. AMR arrived and transported the victim to Niagara Falls Memorial Medical Center for treatment of two large lacerations to the back of his head and face. Officers also observed a possible broken nose. - Niagara Falls Man Pleads Guilty in Airport Hit-and-Run Incident
A Niagara Falls man pleaded guilty to charges stemming from a hit-and-run incident that left a pedestrian seriously injured near the Buffalo-Niagara International Airport earlier this year. Travis Rosario, 51, entered his plea on Monday to one count of leaving the scene of an incident resulting in serious injury. The incident occurred early in the morning on February 27th when Rosario was driving on Luiz Kahl Way. At approximately 4:56am, he struck a 44-year-old male pedestrian from Williamsville who was crossing the road near Genesee Street. Following the collision, Rosario fled the scene without reporting the incident as the victim lay motionless and bleeding in the street. The victim sustained serious injuries including a head injury and multiple fractures. He was transported by ambulance to ECMC for treatment. A fire at a multi-unit apartment building on North Transit Street has left five adults and two children displaced according to the Lockport Fire Department. A volunteer firefighter from the Frontier Volunteer Fire Company suffered a medical emergency while battling a fire early Sunday morning according to the Niagara County Sheriff's Office. - Drunk Motorcycle Operator Drives through Front Lawns, Flees from Police at 60 MPH
Niagara Falls Police were on routine patrol around 4am on September 20th when they observed a motorcycle fail to stop at a stop sign. Officers turned their vehicle toward the motorcycle and observed the driver failing to signal when changing lanes, failing to maintain his lane, and jumping the curb and driving through residents' front yards. At this time officers accelerated to the motorcycle and activated emergency lights. However, the operator of the motorcycle quickly sped up. Dispatch was advised of the situation. The motorcycle was placed at traveling over 60 MPH on Walnut Avenue in a posted 30 MPH zone. Officers lost sight of the vehicle not soon afterward. A short time later, the motorcycle was seen in a parking lot on the northwest corner of Main Street with the driver present and engine running. The male operator was detained until additional officers arrived. The motorcycle was found to have a license plate that came back as uninsured, unregistered and uninspected. The male operator was found to have a suspended license due to 4 scoffs on three separate dates. Due to observations of possible impairment, the operator was asked if he would perform any field sobriety tests. He refused. Officers observed him having slurred and illogical speech along with glassy and bloodshot eyes. There was also a strong odor of alcohol emanating from his person. He also admitted to drinking “some” alcohol earlier that night. The operator was issued 10 traffic tickets and read his DWI/Miranda warnings before being transported to police headquarters for booking and processing. He was held for arraignment as he “refused to blow on the data master.” No further information is available at this time. Upon arrival, officers observed a 2007 Cadillac with the driver-side front window broken out. Inside of the vehicle, the dash was damaged and radio removed. Officers also observed what appeared to be blood located on top of the driver-side door as well as on the rain guard. Also found was a brown napkin located next to the driver-side rear wheel with what appeared to be blood on it. The “generic touch screen radio” that had been taken out of the dash is valued at $150. Niagara Falls Police were performing a premises check around 2:30pm on September 17th in the area of 19th and Niagara Street when a male (male #1) ran into the building with a black cane. A second male (male #2) came running in after him and there was a physical altercation between the two. Officers separated the two and then spoke to male #2. He stated he was driving his truck and stopped at an intersection. While stopped, male #1 came up to his vehicle and asked for money. He said no and began to drive away. As he began to take a right-hand turn, male #1 hit the rear-side panel of his truck with a cane. He put a large dent in the truck and damaged it. Male #1 then took off running into a nearby building. Male #2 ran into the store and that is when officers observed the altercation. The estimated damage to the vehicle is $150. Male #1 was transported to police headquarters for booking and processing. Niagara Falls Police were conducting school zone speed enforcement in front of Gaskill Preparatory on Hyde Park Boulevard around 1pm on September 17th when officers observed a white 2018 GMC Terrain SUV traveling at 39MPH in the posted 25MPH school zone. Officers conducted a traffic stop. Immediately upon approaching the vehicle, a black male sprung from the backseat and began walking away. He was ordered to stop, at which time he placed his fingers in the back of his throat to make himself vomit. Once he was done "carrying on," officers had him sit back in the vehicle. The male stated he was “choking” because he was drinking too much liquor. He then handed officers a mostly empty 200mL bottle of Remy Martin cognac and his NYS ID. The driver, a female, showed a photo of her NYS ID card but admitted she doesn’t have a driver’s license. Both parties stated that they were at the Outlet Mall and trying to make it back to the highway. They were supposedly downtown “trying to get food” and “couldn’t find the highway.” The male was found to have multiple active warrants from other jurisdictions and was detained. Both vehicle occupants were searched, in addition to the car, and nothing of evidentiary value was found. Officers then transported the male to Batavia to meet with Hornell Police. - Goodyear Chemical Plant in Niagara Falls Violated for Cancer-causing Emissions 1,000% Above Safe Levels
For over 15 years, the Goodyear Tire & Rubber Co. chemical plant in Niagara Falls, NY, has been releasing a bladder carcinogen into the air at levels 1,000 percent higher than what state regulators now consider safe. The New York State Department of Environmental Conservation (DEC) issued a notice of violation to Goodyear in July of 2023 for failing to control emissions of the bladder carcinogen ortho-toluidine and another pollutant, diphenylamine (DPA). However, more than a year later the DEC has yet to order the company to reduce these emissions. Data collected by Public Health Watch Ortho-toluidine is a known human carcinogen linked to bladder cancer while DPA is a possible carcinogen that may harm the bladder, kidneys, and liver. The DEC violation notice focuses on two pollution-control devices -- the Tri-Mer scrubber and Elimination Tank 2 -- that have both failed to adequately capture these pollutants. Despite the severity of the issue, the DEC has not taken further action to address the emissions since their violation notice over a year ago. The Goodyear plant in Niagara Falls has a history of occupational outbreaks of bladder cancer among its workers. Federal health investigators found that the disease affected plant workers at a rate four times higher than expected in the general public with exposure to ortho-toluidine identified as the likely cause. Overall, at least 78 Goodyear workers have developed bladder cancer since the mid-1980s. This would be 4x higher than the national average (click HERE for data from National Library of Medicine). More concerning is that people living near the Goodyear plant may also be at risk. DEC documents suggest that the community has not been adequately informed about the emissions and potential health hazards they pose. Niagara County has one of the highest incidence rates of bladder cancer in both the state and the nation. A statement from the DEC stated, in part, “Protecting New York’s air quality, and the health of our communities, is a top priority for DEC and DEC will continue to take the appropriate actions involving the Goodyear Chemical facility in Niagara Falls to ensure compliance with applicable air emission standards and the protection of public health and the environment. … DEC’s investigation continues, which includes communications with the company regarding potential facility modifications." Goodyear, in a statement, claims to be in compliance with the state's prior air permit requirements for ortho-toluidine. "[The Niagara Falls plant] is subject to air permit requirements that are based on the state’s prior [limit] for ortho-toluidine, and Goodyear is in compliance with those permit requirements," Goodyear claimed in a statement. The issue of air pollution and potential life-threatening health consequences from the Goodyear plant adds to Niagara Falls' troubled environmental history dating back to Love Canal. If it is indeed true that the pollution-control devices at the plant have allowed excessive emissions of ortho-toluidine and DPA for years to permeate the community, the failure of the DEC to act is alarming. The state tightened the airborne limit for ortho-toluidine in 2021 due to its potent cancer-causing properties, but the plant's emissions remain unchecked. The Niagara County Department of Health confirmed the first case of West Nile Virus in the area for 2024. The infected resident is hospitalized and receiving medical care. West Nile Virus, which is primarily transmitted through mosquitoes, often presents with little to no symptoms in most individuals. However, those who exhibit symptoms may experience mild effects such as fever, headaches, body aches, and skin rashes. A tragic accident in North Tonawanda on Monday morning resulted in the death of a Jamestown man. The North Tonawanda Police Department announced on Tuesday that Terry Crick, 58, was struck while riding his E-Bike. The motor vehicle accident involving a bicyclist occurred around 11:25am at the intersection of Twin City Memorial Highway and Tremont Street. Preliminary findings from the investigation indicate that Crick, who was traveling eastbound on Tremont Street on his E-bike, failed to yield the right of way. At the same time, a 2014 Ford Explorer was traveling and struck Crick. He was immediately transported to ECMC for treatment of life-threatening injuries. Sadly, he succumbed to his injuries on Tuesday. The driver of the Ford Explorer is fully cooperating with the ongoing investigation. There have been no charges brought in connection with the crash. - Starpoint Superintendent Pleads Not Guilty to DWI Charge
Starpoint Central School District superintendent Sean Croft pleaded not guilty to a charge of driving while intoxicated in West Seneca Town Court on Tuesday, September 18th. This is Croft's first court appearance after a motor vehicle accident on August 31st where he struck a tree on Nina Terrace near the intersection of East and West Road. According to prosecutors, Croft was driving under the influence at the time of the incident. He was arrested after allegedly failing field sobriety tests and was subsequently taken to the West Seneca Police station. However, Croft allegedly refused to undergo a breath test to determine his blood alcohol concentration (BAC) percentage. Witnesses at the scene reported that Croft claimed the accident occurred as a result of swerving to avoid hitting a squirrel. In addition to the DWI charge, Croft also faces two other traffic infractions. Following his arrest, Croft was placed on leave from his position as superintendent. He was asked to leave and did exit the building. However, he then turned around and started to headbutt the front glass door repeatedly causing it to shatter. The estimated damage to the door is $1,000. The bartender said that the suspect departed and laid down nearby. Officers were able to quickly locate and identify him. A Niagara Falls woman has pleaded guilty to second-degree vehicular assault after hitting and seriously injuring a juvenile while under the influence of marijuana. The Niagara County District Attorney's Office announced the plea agreement on Tuesday afternoon. The victim, identified as Nevaeh Quarantillo, was riding her bicycle on Ferry Avenue when she was struck by a vehicle driven by Juajhane Cox, 25. The collision resulted in serious, life-altering, injuries to Quarantillo. While pinned under Cox's vehicle, oxygen could not get to her brain for almost 10 minutes. The deprivation of oxygen resulted in her being in a coma at Oishei Children’s Hospital for more than five months following the incident. Quarantillo's family documents her progress on a Facebook page called "Neveah’s Prayer Book." She has made some miraculous improvements over the last year and is now off a ventilator and breathing on her own. This is something doctors said she would likely not be able to do again. Niagara County District Attorney Brian Seaman expressed his sympathy for the young girl and her family, stating, "Unfortunately, the young girl who was struck by the defendant sustained horrible injuries that she and her family will live with for the rest of her life." - Niagara Falls Man Released on Bail After Setting Woman on Fire, Sells Food Truck that he Used in Crime
A Falls man accused of setting a woman on fire outside his food truck has been released on bail, according to the Niagara County District Attorney's Office. Barinder Singh, 38, who pleaded not guilty to a single count of first-degree assault, has posted bail using the proceeds from the sale of his food truck. The food truck, which had been parked in a gas station parking lot on Niagara Street, disappeared shortly after Singh's arraignment in Niagara County Court on August 9th. Singh had initially been released on his own recognizance after being charged with a B felony level assault in Niagara Falls City Court. However, after his indictment in Niagara County Court there was a reconsideration of his bail status. Following Singh's plea of not guilty in the grand jury indictment, Niagara County Court Judge John Ottaviano ordered him to be held on $100,000 cash, $200,000 bond, or $1 million partially secured. Due to the heinous nature of the crime, Niagara County prosecutors argued that Singh posed a danger to the community. Singh being released on bail has raised concerns among law enforcement and the public, let alone his victim who remains hospitalized at ECMC. The victim, a 48-year-old woman, continues to receive treatment for severe burns to her head, arms, and body. The incident occurred in the early hours of Sunday, August 4th when Falls police responded to a call at the location of Singh's food truck in the parking lot of a gas station on Niagara Street. Officers discovered a female victim who suffered extensive burns. It has been confirmed that she sustained third degree burns across her body. The victim's identity has not been released by the police. Charging information revealed that the woman was allegedly confronted by Singh who accused her of stealing from his food truck. He became irate, resulting in Singh dousing her with a flammable liquid and setting her on fire. Niagara County District Attorney Brian Seaman expressed his concern over the release of Singh on bail given the violent nature of the crime and the severe injuries inflicted upon the victim. - Woman Goes Berserk on Hotel Employee after Finding Out Pool was Closed
Niagara Falls Police responded to the Holliday Inn Express on the 10000 block of Niagara Falls Boulevard around 5:15pm on September 14th after reports of a customer dispute that was later changed to criminal mischief. Upon arrival, officers met with an employee at the hotel. The suspect had a reservation at the Holliday Inn Express for September 14th. The employee stated that while she was signing into the hotel, the suspect saw a sign that the pool was out of service for the week and asked for a refund. The employee told her that was not possible, at which point the woman became irate. The complainant told her that she could talk to the hotel manager and that he would be at the hotel Monday morning (two days away). The suspect started swearing at the complainant and a co-worker. She picked up the front desk HP computer, held it over her head, and thew it behind the counter. The frame of the computer screen was damaged (valued at $200). During the altercation, she also damaged a black card holder sitting on the front desk valued at $45. Officers then spoke with the suspect who stated a week ago she made reservations at the Holiday Inn for her daughter’s birthday with the intention to male a reservation that could accommodate a swimming function. She stated a refund was requested because the pool was closed. “I ruined my daughter’s birthday because I got mad,” she said. Officers then spoke to the hotel manager who stated that they wished to press charges. The suspect was detained, placed in the rear of a patrol vehicle. She was transported to police headquarters for booking and processing without incident. No further information is available at this time. - Male Beaten Senseless on 19th Street over Bicycle, Runs from Ambulance While Being Treated
Niagara Falls Police were assigned to routine patrol around 4:30pm on September 14th in the area of 19th Street when officers observed an individual known to law enforcement lying on his back under the Ashland Street sign. Officers notified dispatch to send additional cars as there was a large group of people congregating and blocking traffic. When an officer got out of the vehicle, he was immediately told that the injured male "fell off his bike.” Another male was seated in a newer model charger lowered the window and said, “he’s good man, he just fell off a bike that’s all.” Officers observed that the injured male appeared intoxicated as he was slurring his words and “not making any sense.” He had swelling on the right side of his forehead and a bloody nose. AMR and Niagara Falls Fire were requested to the scene to provide medical treatment. While waiting for first responders to arrive, the injured male said a black sedan had struck him and took off. After several officers arrived on scene, the initial responding officer went inside a nearby store to look at their surveillance footage. The surveillance video showed that the injured male and another black male were in front of the building when they appeared to get into a dispute over a bicycle. The injured male lets go of the bicycle and squares up in a fighting stance with the other male. The pair begins to exchange blows and the fight eventually ends up going to the ground. Once both parties got up they started to fight again. This time the unknown male knocks the injured male to the ground, stands over him, and begins to punch him in the face repeatedly. The unknown male then gets into a vehicle and leaves. AMR and Niagara Falls Fire responded to provide medical treatment for the injured male. However, the official report stated that “while assisting officers were watching [the injured male] be treated, he was able to take off running away from them and the paramedics.” He did not come back. Niagara Falls Police responded to the 2200 block of Woodlawn Avenue around 11:45am on September 14th after reports of a burglary. Upon arrival, officers spoke to the complainant who stated that she left her home on September 13th around 9pm and returned the following day around 11:30am and noticed that her 50-inch Roku TV was missing. She valued that TV at around $300. The complainant told police that her brother was supposed to be at the house while she was gone but did not suspect him of taking the TV. Officers checked the home for signs of forced entry with negative results. There were no cameras on location to catch anyone coming into or out of the apartment. There are no suspects.
