- Local Man from Barker Enters State Senate's Veteran Hall of Fame
On Monday, December 18th, New York State Senate Minority Leader Rob Ortt had the honor to meet Senate Veteran Hall of Fame inductee, Herbert Loesch, of Barker, and present him with his official recognition of becoming a member of the New York State Senate Veteran’s Hall of Fame. “Herbert Loesch was chosen for this prestigious honor because he exemplifies what it means to be a patriotic American and proud military veteran,” said Senator Ortt. “Mr. Loesch not only proudly served his country during the Korean War, but he has spent a lifetime preserving and showcasing our great military history – it is my sincere hope that Mr. Loesch’s efforts have and will continue to inspire many others to appreciate and respect our military and its many service members.” A decorated Army veteran, Mr. Loesch’s military career began in 1952 when he enlisted in the US Army, following his education at Alfred State where he majored in biology and minored in chemistry, receiving a BA degree. After basic training at Camp Pickett in Virginia, Mr. Loesch would receive advanced medical training at Fort Devens in Massachusetts. After his training, he was deployed to Korea where he served as a Medic with the 24th Division, obtaining the rank of Sergeant First Class. His accolades include the Korean Service Medal, Presidential Unit Citation (ROKDA), United Nations Service Medal, and the National DEF Service Medal. In 1954, Mr. Loesch was honorably discharged from the Army and became actively involved in the Barker Chapter of the American Legion Post #425 as well as a member of the Veterans of Foreign Wars. Mr. Loesch collects, maintains, and proudly displays Military Memorabilia at his home, including a collection of more than 1,000 toy jeeps. He keeps a prominent Military Display of World War II and Korean War at the Barker High School, utilizing these collections to discuss our nation’s military history and encourage young people to pursue careers in the armed forces. During local parades, Mr. Loesch can be found in the lineup with his restored World War II Willys Jeep, wearing his full military uniform. Mr. Loesch remains an active member in his community as well, serving as treasurer in his church, treasurer to the Western New York John Deere club, a member of the Masonic Lodge #639 and volunteers to place flags at military gravesites. Mr. Loesch currently lives in Barker with longtime partner, Grace. His two children also reside in New York.

However, it is crucial to recognize that our own state prospered from the institution of slavery. It is an unsightly aspect of our history, yet it is indisputably true." The new legislation, passed by state lawmakers back in June, mandates a comprehensive study by the commission into the level of federal and state government backing of slavery. The committee will additionally explore how New York State, which ended slavery entirely by 1827, participated in the transportation of enslaved Africans and investigate the continuous impact of slavery on today's Black New Yorkers. A team of nine will constitute the commission, required to present a report a year post their first meeting. Although they could suggest financial restitution, such recommendations would not be obligatory. The purpose of these findings is to prompt alterations in policies and trigger initiatives and programs that aim to counteract the negative impacts of slavery on the Black community in New York.

This facility is situated inside the old Niagara Falls High School at 1201 Pine Ave. This undertaking aims to rejuvenate the 1,000-seat auditorium at the center, rendering it suitable for current live events. Second, the state confirmed a commitment of $2.25 million for a $2.5 million project targeting the renovation of several vintage buildings within the Oakwood Cemetery at 763 Portage Road. This task includes restoration work on the cemetery's chapel, constructed in 1877, and the Green & Wicks marble mausoleum built in 1913 and the Stone Office set up in 1922. Eventually, all these edifices are envisioned to serve as venues for heritage tourism happenings in sync with the Niagara Falls National Heritage Area. Niagara County Legislature Chairman Becky Wydysh today announced the new Niagara County ambulance service answered its first call this past Sunday and is now fully operational to serve the residents of Niagara County. The county has two ambulances in service. “Over the last several years, we have faced the dual problems of a declining number of volunteer firefighters coupled with more regulatory demands on those same volunteers,” said Wydysh. “This is a problem across the state and the result leads to longer response times for citizens who need help. The county had to establish an ambulance service to supplement our volunteers.” Wydysh thanked the county’s volunteer fire companies for their patience as the county was taking the necessary steps to put the new ambulance service in place. Jonathan Schultz, Niagara County Director of Emergency Services, said the new service is comprised of two crews and a supervisor with a service that covers from 5 a.m. to 5 p.m. for one crew and 6 a.m. to 6 p.m. for the second crew every day of the week. “We extensively reviewed our data on EMS calls and it came as no surprise that the toughest challenge for our volunteer companies is to respond to calls during the workday,” said Schultz. “So we worked closely with our Fire Advisory Board and our fire chiefs to devise a schedule to fill in those gaps. I want to stress we view the county ambulance services as supplemental to the great work already being done by our volunteers.” Schultz said over the last month, the county has hired six EMTs, four paramedics, two supervisors and a division manager for the ambulance service. "Our new team was excited to finally begin serving the people of Niagara County and we have already answered more than a dozen calls,” said Schultz.

- Boat Tragedy in Lockport Cave Due to Compromised Flotation Devices, Says State
New York State has attributed the cause of the Lockport Cave tour boat capsize earlier this year, which resulted in one death and several injuries, to faulty floatation devices. On Monday, the Lockport Police Department disclosed its investigatory files from the Lockport Cave case. This includes a report from the Vessel Incident Analyses Team of the state Office of Parks, Recreation and Historic Preservation, which was brought in by LPD for investigative support. According to the State Parks report, on June 12, the boat, which was carrying 28 passengers and the boat operator, flipped over in an old hydraulic tunnel, due to it being top heavy and unstable. The incident led to the tragic death of 65-year-old Harshad Shah, president of Budget Host Inn-Niagara Falls, who was trapped beneath the overturned boat. All passengers were local hospitality workers visiting local tourist sites. The analysis team performed tests on the boat’s flotation devices two days after the accident. The test results indicated the devices were faulty, causing the boat to be at high risk of a rapid capsize to the right. The report describes the Lockport Cave boat as a handmade, flat-bottomed and rectangular vessel, built from seven flotation devices enclosed in a wooden framework, a plywood deck that could seat up to 36 riders, and powered by two motors, one each at the front and rear. According to the report, the flotation devices on the right side were defective, due to being pierced by screws which allowed them to fill with water. This resulted in the boat leaning and ultimately flipping to the right. The state report added that despite company owner, Tom Callahan’s assertions of providing a safety briefing, most passengers attested to not receiving any safety instructions prior to the boat ride. Furthermore, they were not offered life jackets or informed about the presence of any flotation equipment such as a buoy on the boat.

- Matt Araiza Cleared as Accuser Withdraws Lawsuit, Sets Eyes on NFL Comeback
The woman who accused former San Diego State University student Matt Araiza of rape has withdrawn her lawsuit against him. Araiza, nicknamed 'Punt God', was alleged to have sexually assaulted her along with others at a 2021 party near the university. Although she was only 17 years old at the time, the incident was ruled as consensual by both the school and the legal authorities. This victory is somewhat hollow, Araiza's lawyer Dick Semerdjian expressed, as reported by Yahoo Sports. He lamented the precious 16 months that Araiza had lost fighting unfounded charges and defending his future NFL career. Presumption of innocence is essential in our justice system, Semerdjian emphasized. Despite public uproar when accusations surfaced, Araiza maintained his innocence, a stance bolstered by extensive evidence that eventually led to his voluntary dismissal from the case. The lawsuit is done with and Araiza has emerged victorious, Semerdjian added. Araiza's next steps include focusing on his return to the NFL and resurrecting his promising punting career. In the lawsuit, Araiza was accused of forcefully pushing the young woman onto a bed and sexually assaulting her without her consent. The episode, which allegedly left her traumatized, was claimed to have lasted an hour and a half. While Araiza did confirm having sex with her, he asserted he was unaware of her being a minor. Later, evidence showed Araiza had left the party before the alleged group sexual assault took place. Following the initiation of the lawsuit, Araiza, who was drafted by the Buffalo Bills in 2022, was cut from the team during training camp. Araiza now plans to bring a defamation suit.
- From Post Office to Pot Store: New Dispensary Premier Earth Opens on Hertel Ave
A few weeks after a judicial restriction was removed allowing new legal marijuana shops to commence operations in the state, a third location is set to open in Western New York. Premier Earth is slated to commence operations at 4:20 pm this Wednesday at 1297 Hertel Ave., Buffalo, NY, in what used to be a post office building. According to Mark Schlueter, sales director and general manager, the response from the community has been encouraging. He mentioned how locals, who were previously dependent on illicit sources for marijuana, expressed positivity regarding the opening of a licensed store in the area. Joe Wojciechowski, the owner of the store and a native of the East Side, obtained his license in April and leased the venue in June. However, due to a lawsuit filed by a group of military veterans and medical marijuana shop owners alleging unconstitutional exclusion from the licensing process, the store's opening was postponed. Schlueter noted the financial burden the delay put on the business, but also pointed out the encouraging support they've received from existing dispensaries and other license holders. As of now, two other licensed marijuana shops are operating in Western New York, located on Main Street and in Depew.

Last month, the City of Niagara Falls introduced a $558,000 Bridge District Small Project Fund. The City of Niagara Falls received funding from New York State’s Downtown Revitalization Initiative (DRI) to support the program. The family of Gabby Kranock, a 19-year-old who suffered serious injuries in a crash more than a year ago, has confirmed her passing. The crash occurred in Portville in September of 2022 and left Kranock paralyzed from the shoulders down. It was caused by alleged drunk driving and also claimed the life of 19-year-old Kayden Belleisle. Kranock's plight touched the Western New York community, leading to many acts of generosity. - Downtown Niagara Falls Set for Revamp With New Heritage Walk Project
Preliminary designs for the Niagara Heritage Gateways Project were unveiled by the USA Niagara Development Corporation (USAN) and the City of Niagara Falls during a public information session today. - Niagara Falls Police Department Update on Rainbow Bridge Fatal Crash
(Niagara Falls, NY - NFPD Press Release) The investigation into the crash at the Rainbow Bridge is continuing by the Niagara Falls Police Department’s Crash Management Unit. The data recorder for the vehicle has been recovered but appears to have been severely damaged in the crash. Officers are diligently working towards recovering any information from the recorder. Investigating Officers are in communication with Bentley Motors, they have provided us with documentation about prior recalls as well as general information about the data recorder, “black box” (location in the vehicle etc.) Bentley Motors is requiring subpoenas to release any personal information, documentation, and records on this particular vehicle. Our Officers are working with the Niagara County District Attorney’s Office to secure said subpoenas. NFPD has been in contact with the National Highway Traffic Safety Administration and the National Transportation Safety Board. We have been advised they are meeting this week to discuss the crash and other Bentley issues. We are waiting on the Medical Examiner’s report. As this investigation progresses and more information is gained, NFPD will do our best to get it out.

Authorities are investigating mechanical failure as the potential cause of a deadly incident on Rainbow Bridge that occurred in Niagara Falls on Nov. 23rd. Two people tragically died when their 2022 Bentley, a luxury car model, crashed and burst into flames. Mayor Robert M. Restaino revealed that the Niagara Falls police are gearing up to serve Bentley Motors with a subpoena. The police are seeking information stored in the vehicle's black box, which the car manufacturer is reportedly refusing to release willingly. The Mayor, while speaking to The Buffalo News, confirmed that Bentley officials instructed the police to seek legal channels in order to retrieve data from the black box. This crucial information would give insights into the vehicle's speed at the time of the incident, and whether the driver applied brakes or not. Restaino underscored that the preliminary findings strongly point to a mechanical malfunction as the probable cause of the accident. The authorities found no evidence suggesting reckless or deliberate over-speeding by the driver, Kurt Villani, leading to the catastrophic crash that catapulted the vehicle over an 8-foot fence before it exploded near the inspection booths. The Mayor also clarified that police had ruled out a medical emergency as a factor in Villani’s supposed high-speed and erratic driving towards the bridge. Embodying the spirit of Christmas, Old Fort Niagara will transform into a depiction of past holiday celebrations. The 'Castle by Candlelight' fundraiser, illuminating the entire fort, is scheduled to run from 6:30 to 8:30 p.m. on December 9th and December 16th. The Executive Director, Bob Emerson, expressed that each year brings the introduction of novel elements. This year, they will be featuring crafts creation, alongside Native American songs and narratives. Each area within the French Castle and adjacent buildings will be inhabited by volunteers role-playing as silversmiths from the 18th century to exhibit jewel crafting, musicians serenading guests with songs from that period, and a Recollet priest who will recite the Christmas narrative in Latin inside the fort's chapel. In addition, garrison volunteers will demonstrate the 'feu de joie' or 'firing of joy,' a synchronized firing of muskets and cannons, twice each evening. Exhibitions will not be solely confined to the 18th-century; volunteers will also present diverse Christmas traditions experienced by soldiers up until the Second World War. Emerson remarked that this last fundraiser of the year aims to generate $30,000. Proceeds will be directed towards supporting educational programs for students, a segment whose 2023 attendance at the fort marked a doubling from 2022. Next Wednesday, December 13th will be a “Miracle in North Tonawanda” to benefit Twin Cities Community Outreach (TCCO), home of the NT InterChurch Food pantry, according to Niagara County Legislators Rich Andres, Randy Bradt and Jesse Gooch, who are spearheading the effort. The Riviera Theatre will be hosting a free public screening of the Christmas classic “Miracle on 34th Street” with all those attending encouraged to bring a non-perishable food item to the event. There will also be a special hot chocolate bar set-up, with all proceeds from those sales going to TCCO. In addition, many restaurants across North Tonawanda have agreed to donate 10 percent of their sales on December 13 to TCCO in support of the food bank. Each restaurant will also have contribution envelopes on their tables for patrons who would like to make an additional donation. “What better way to get into the spirit of Christmas than enjoying dinner at any of the fabulous establishments in North Tonawanda, followed by watching one of the greatest holiday films ever made in A Miracle on 34th Street on the big screen at the Riviera,” said Legislator Andres. “At the same time, you will be assisting TCCO in providing food, clothing and holiday good will to people in our community who are in need.” The Riviera Theatre is located at 67 Webster Street in North Tonawanda.
