- 85-Year-Old Woman Crosses Niagara Falls in Pursuit of 1,000 Skydives
Kim Knor, an 85-year-old woman, is proving that age is nothing but a number as she continues her pursuit of 1,000 tandem skydives. Knor, described as adventurous and brave, has been skydiving since 1959 and has set a goal to complete 1,000 jumps. This weekend, she added Niagara Falls to her list of jumps, marking another milestone in her remarkable journey. "I've been trying to get to 1,000 jumps since I started in 1959," Knor shared. "I've had many interruptions, raising a family, different things — life gets in the way. But now, with more free time, I'm finishing what I started more than six decades ago." On Saturday, Knor geared up to jump with the team at Skydive the Falls in Youngstown. Having traveled all over the country and the world to skydive, she had been eagerly looking forward to experiencing the breathtaking view of Niagara Falls from a parachute. "To see it from the sky, oh my gosh, it was really exciting," Knor exclaimed. The thrill, the rush, and the beauty of seeing the world from a whole different perspective are what drive Knor's passion for skydiving. Jason Berger, co-owner of Skydive the Falls, expressed admiration for Knor's spirit, saying, "It's the thrill, it's the rush, and then it's the beauty of everything, looking at the world from a whole different perspective." Knor's dedication to the sport has not gone unnoticed. In 1962, she was a member of the first-ever U.S. women's parachute team, paving the way for other women to pursue skydiving. Jennifer Jones, a tandem skydive instructor, credits Knor as a pioneer in the sport. "Without Kim being the pioneer that she is, I would not have become a tandem instructor," Jones said. "This has been somewhat of a male-dominated sport, but Kim has set the pace for women to develop themselves into instructional positions." Knor's inspiring journey motivates people of all ages to chase their dreams. Jones, who turned 62 on the same day as Knor's jump, shared, "Kim and I's aggregate age is 147, so I haven't quit yet. I'm still pursuing the sport, and I just hope I can last until 85." With each jump, Knor moves closer to being awarded her gold wings for completing 1,000 skydives. "Don't close the doors and listen to people say, 'Oh no, you're not going to do that, that's too scary or this is too this' — you have to feel what's inside you," Knor advised. "You see someone wearing the gold wings, it's really significant. That's what I want. I've got another 328 to go." Kim Knor's incredible determination and passion for skydiving serve as an inspiration to people of all ages, reminding us that it's never too late to pursue our dreams and embrace the thrill of life's adventures.
- Town of Niagara Reverses Course, Embraces Adult-Use Cannabis Sales and Consumption
In a significant shift, the Town of Niagara Board is set to reconsider its stance on adult-use cannabis retail dispensaries and on-site consumption sites. A public hearing will be held on Tuesday night to discuss the repeal of a 2021 local law that previously opted the town out of allowing such establishments. Following the hearing, the board is expected to replace the law with a new one that will opt in to permit cannabis sites within the town. Joining a growing number of municipalities across New York, the Town of Niagara's decision to allow adult cannabis sales and consumption is expected to be accompanied by the approval of a resolution supporting Niagara Hemp Supply's application for a state license. The company, operating as One Hemp Holistics, is currently engaged in the sale of hemp-based Cannabidiol (CBD) products. Town Supervisor Sylvia Virtuoso explained that One Hemp Holistics had applied for a state license and sought the town's support. The recommendation to opt in came from Police Chief Craig Guilani and board member Mike Lee, who also serves as the deputy police superintendent in Niagara Falls. Their compelling arguments prompted a reconsideration of the town's previous stance on legalized marijuana sales and consumption. Virtuoso, who initially opposed the idea, acknowledged the influence of law enforcement officials in changing her perspective. She attributed the town's earlier decision to opt out of marijuana legalization to the uncertainties surrounding the process at the time. However, with more knowledge and experience gained over the years, Virtuoso believes it is necessary to reevaluate the town's position. Chief Guilani expressed his support for the policy change citing the proliferation of illegal cannabis shops and concerns for public safety. By opting in, the town can regulate sales and consumption ensuring transparency and accountability within licensed dispensaries. Board member Mike Lee echoed Guilani's sentiments, emphasizing that the sale of marijuana is an enduring reality. He stressed the importance of supporting a legal cannabis market to eliminate unregulated products and reduce potential risks associated with substances like fentanyl being mixed with cannabis. Virtuoso also highlighted the imminent opening of the first licensed cannabis dispensary in Niagara Falls, located on the border of the city and town. Considering its proximity, she questioned why the town should not embrace the opportunity as it would provide better control over the industry and aid in shutting down illegitimate businesses.
- Uncovering the History and Horrors of Love Canal in Niagara Falls, USA
Niagara Falls, USA, is renowned for its breathtaking natural beauty and captivating attractions. However, amidst the splendor lies a dark chapter in the city's history - Love Canal. This article delves into the haunting past of Love Canal, shedding light on its history and the horrors that unfolded in Niagara Falls. While it may be a somber part of the City's story, understanding Love Canal is crucial to appreciating the city's resilience and commitment to environmental preservation. Love Canal, located in the southeastern part of Niagara Falls, was initially envisioned as a dream community in the 1890s. The canal was intended to be a hydroelectric power source, but the project was abandoned, leaving behind a partially dug canal. In the 1940s, the area was repurposed as a chemical waste disposal site by the Hooker Chemical Company. Over the years, Love Canal became a dumping ground for toxic chemicals, including hazardous waste. The site was poorly managed and the chemicals began seeping into the ground - contaminating the surrounding area. The consequences of this environmental disaster were devastating - leading to severe health issues, birth defects, and even death. In the 1970s, the alarming health effects caused by Love Canal's toxic waste came to light. Residents, particularly those living in the Love Canal neighborhood, fought tirelessly for recognition and relocation. Their efforts led to the declaration of a state of emergency and the eventual evacuation of over 800 families from the area. The Love Canal disaster served as a wake-up call, prompting the creation of environmental legislation and regulations to prevent similar incidents. The incident led to the establishment of the Superfund program, which aimed to clean up hazardous waste sites across the country. Love Canal became one of the first sites to undergo extensive cleanup efforts. While the horrors of Love Canal cannot be forgotten, the incident sparked a nationwide conversation about the importance of environmental protection. It served as a catalyst for stricter regulations and increased public awareness of the potential dangers of toxic waste. Today, Love Canal stands as a reminder of the need for responsible waste management and the ongoing commitment to safeguarding the environment. Niagara Falls, USA, is a city of resilience and the story of Love Canal is an integral part of its history. Understanding the horrors that occurred at Love Canal allows us to appreciate the city's commitment to environmental preservation and the steps taken to prevent similar incidents.

- Congresswoman Claudia Tenney Urges Governor Hochul to Pardon Former President Trump
In a bold move, Representative Claudia Tenney (R-24) has called upon Governor Kathy Hochul to pardon former President Donald Trump. Tenney, who represents parts of Western New York, issued a letter to the governor addressing the recent verdict in the hush money trial against Trump where he was found guilty of 34 counts of falsifying business records, marking the first felony conviction for a former president. In her letter, Tenney expressed her concerns about the implications of the verdict on the justice system. "This case undermines the impartiality and credibility of our once venerable justice system and cannot be allowed to stand," she wrote. The congresswoman, who received Trump's endorsement in March, has been critical of his conviction in the past. Tenney's district includes Genesee, Wyoming, and the eastern half of Niagara County. As a member of the New York Bar and the daughter of a New York State Supreme Court Justice, she brings a unique perspective to the issue. In a statement on May 30, Tenney expressed her dismay at what she called the "unethical politically motivated antics" of Judge Merchan, who she believes imposed unnecessary and unconstitutional gag orders on President Trump, hindering his ability to campaign freely. Furthermore, Tenney took aim at Manhattan District Attorney Alvin Bragg calling for his removal and accusing his office of targeting individuals in search of crimes. She believes that millions of Americans, including those who do not support President Trump, would agree with her assessment of the case and fully support the pardoning of the former president. The congresswoman's plea to Governor Hochul comes at a time when the nation is closely watching the aftermath of the hush money trial. The pardon power of the governor has been a subject of debate, and Tenney's request adds another layer of complexity to the ongoing discussions. As the issue continues to unfold, it remains to be seen how Governor Hochul will respond to Tenney's request and what impact it may have on the broader political landscape. The call for a pardon has ignited a passionate debate among supporters and critics alike, highlighting the deep divisions that still exist in the aftermath of the Trump presidency. The story will undoubtedly continue to develop, and we will closely monitor any updates regarding the congresswoman's request and the governor's response.

In a significant effort to address the issue of homelessness among veterans, a national nonprofit organization has announced plans to construct a 91-unit apartment building in Cheektowaga. The organization, known as the Tunnel to Towers Foundation, aims to provide permanent housing for homeless veterans by tearing down a long-vacant nursing home at 3600 Harlem Road. The proposed project, named Veterans Village, will be presented to the town planning board by the Tunnel to Towers Foundation in the coming week. The foundation, established in the aftermath of the September 11 attacks, has been dedicated to supporting first responders, veterans, and the families affected by the tragic events of that day. Gavin Naples, the vice president of the Tunnel to Towers Foundation, expressed the organization's commitment to providing high-quality and affordable housing for veterans in need. He emphasized that Veterans Village will offer permanent housing solutions rather than transitional programs or shelters. "These are high-quality, affordable housing programs for veterans," Naples stated. "This is permanent housing. It's not a transitional program; it's not a shelter." The project aims to address the pressing issue of homelessness among veterans, particularly those who are most vulnerable and struggling to find stable housing. By offering permanent housing options, the Tunnel to Towers Foundation seeks to provide a stable and supportive environment for veterans who have experienced homelessness. The proposed 91-unit apartment building will not only provide a safe and secure place for homeless veterans to live but will also offer essential services and resources to support their transition to independent living. The foundation's initiative reflects a deep commitment to improving the lives of those who have served their country and ensuring that they receive the support they deserve. The plans for Veterans Village demonstrate the Tunnel to Towers Foundation's dedication to making a positive impact on the lives of veterans in need. By repurposing the long-vacant nursing home, the organization aims to create a community that fosters a sense of belonging and provides a foundation for veterans to rebuild their lives. As the project moves forward, the Tunnel to Towers Foundation hopes to garner support from the community and local authorities to ensure the successful implementation of Veterans Village. The initiative represents a significant step towards addressing the issue of veteran homelessness and providing a brighter future for those who have bravely served their country. The town planning board's review of the project will be a crucial milestone in the development of Veterans Village. If approved, the construction of the 91-unit apartment building will commence, bringing hope and stability to homeless veterans in Cheektowaga and serving as a model for similar initiatives across the nation.
- Grand Island Man Convicted of Murder
Ronald Olson, a 44-year-old resident of Grand Island, has been convicted and found guilty of multiple charges, including murder, by a jury. The charges stem from an incident that occurred in Buffalo last year where Olson killed an 18-year-old and injured four other individuals. The tragic incident took place on March 20, 2023 at approximately 5am. According to officials, Olson approached a parked Jeep at a gas station located on Main Street near Winspear Avenue. He allegedly attempted to sell clothing to the occupants of the vehicle. However, the Jeep departed from the parking lot and continued driving south on Main Street prompting Olson to give chase in his Chevy Silverado. Prosecutors revealed that Olson believed the individuals inside the Jeep had taken off with the clothing he was trying to sell. Acting under circumstances that demonstrated a depraved indifference to human life, Olson recklessly engaged in conduct that posed a grave risk of death to another person. He intentionally struck the driver's side of the Jeep with his truck causing the vehicle to veer off the roadway. The Jeep collided with a light pole and then crashed into a tree near the intersection of Benwood Avenue. Tragically, the 18-year-old driver lost their life as a result of the collision while four other occupants sustained injuries. The jury's verdict holds Olson accountable for his actions, convicting him on 10 counts including murder. The Erie County District Attorney's Office expressed satisfaction with the outcome, emphasizing the gravity of Olson's conduct and the devastating consequences it had on the victims and their families. Olson now awaits sentencing where he will face significant state prison time. The community mourns the loss of the young victim and stands in solidarity with the injured individuals and their loved ones.
- UFC's Dana White Slams Niagara Falls Casinos in Expletive-Filled Rant
Dana White, the head of the UFC, has unleashed a scathing attack on the "shady" casinos in Niagara Falls. In a recent interview that quickly went viral on social media, White held nothing back as he shared his negative experience with the casinos in the area. During the interview, White was asked about the questionable practices that casinos employ to deceive and cheat their patrons. This prompted him to launch into an unfiltered tirade about his personal encounter in Niagara Falls. WARNING: STRONG LANGUAGE White began the rant by expressing his frustration, saying, "There's so much s***, I wish I could remember the name of this f***ing casino. It was up in Niagara Falls. Piece of s*** casino that I went to. This is why you don't want to play at those types of casinos." He went on to recount an incident where a casino host offered him a million dollars in credit to play. Excited by the prospect, White accepted the offer only to find out later that the credit was limited to $300,000. Feeling deceived, White expressed his disappointment, saying, "I thought we were talking about a million? The host responded, 'Yeah, if you lose, hopefully you don't, I'll just keep bumping it.'" White ultimately lost the $300,000 and was denied any further credit. Frustrated by the experience, he couldn't recall the name of the specific casino or whether it was located on the American or Canadian side of the border. Nevertheless, he concluded his rant by condemning all the casinos in the Niagara Falls area, calling them "dirty, shady, s****y places" and advising people to avoid playing there. While White expressed his disdain for the Niagara Falls casinos, he made it clear that he holds a special affinity for Las Vegas, where the UFC is headquartered. He encouraged gamblers to visit Vegas, highlighting the abundance of competition and the superior treatment they can expect from the casinos along the famous Las Vegas Strip. Following White's outburst, social media users speculated about the identity of the casino he was referring to. Some suggested it was Fallsview, while others claimed that all casinos in Canada are subpar. One user confidently asserted that it was Seneca Niagara. However, some users pointed out that White's grievances are unique to someone of his financial standing dismissing them as "rich guy problems." They emphasized that the average person would never consider gambling with such large amounts of credit. As the controversy continues to unfold, it remains to be seen how the Niagara Falls casinos will respond to White's scathing criticism. You can watch the full video here: https://t.co/1YNaE9Kdms.

- Train Crash Victims' Attorneys File Petition Against North Tonawanda Police and City for Negligence
Attorneys representing two victims of a tragic train crash in North Tonawanda have taken legal action against the North Tonawanda Police Department and the city. The crash, which occurred last month, claimed the lives of three individuals. The attorneys filed a petition in State Supreme Court in Niagara County on Monday, alleging police negligence leading up to the incident. The victims who lost their lives in the crash have been identified as 69-year-old David McMinn, 66-year-old Olive Geldart, and 6-year-old Ra’Mari Geldart. The petition states that when McMinn attempted to turn onto Felton Street, his vehicle was obstructed by multiple police patrol vehicles from various agencies, preventing him from completing the turn and forcing him to remain on the railroad tracks at the intersection of Felton Street and River Road. According to a witness, the pickup truck entered the tracks, and within 20 seconds, the crossing gates came down, resulting in the collision with the train. On the night of the incident, police were conducting a saturation patrol in the area, with multiple local police agencies cracking down on warrant arrests and conducting traffic stops. It has been revealed that a traffic stop was being conducted in the vicinity just before the crash occurred. In their petition, the attorneys are seeking access to various pieces of evidence, including police reports, the identities of the police agencies present within a specific radius before and after the incident, photographs, Amtrak train data, area surveillance video footage, body camera recordings, and 911 call recordings. The attorneys had previously filed a Freedom of Information Law request for this information and documentation but were denied. The filing of this petition marks a significant step in the legal process as the attorneys seek to uncover the truth behind the tragic train crash and hold the responsible parties accountable for their alleged negligence. The outcome of this case will be closely watched by the community as they seek justice for the victims and their families.
- Senator Ortt, Assemblymen Norris and Morinello Praise Lockport Cave Legislation
Today, New York State Senator Rob Ortt, alongside Assembly Members Mike Norris and Angello Morinello, discussed the passage of Senate Bill S9241 and Assembly Bill A10399, regarding the Lockport Cave boat tour. The legislative action clearly defines that the Department of Parks, Recreation and Historic Preservation is tasked with the oversight of the Lockport Cave and similar businesses. The bill also provides that an inspector from the Department of Parks, Recreation and Historic Preservation will at least annually inspect any vessel operated on privately or publicly owned underground, non-navigable waterways with no navigable inlet or outlet that carry passengers for compensation. In addition, the bill also makes technical corrections and related provisions, and adds penalties for non-compliance. “In the course of the investigation of this tragic incident, it came to light that there is no state agency tasked with overseeing these types of attractions. One of my top priorities this legislative session was to change that, ” said Senator Ortt. “With the passage of this legislation, we’re ensuring patrons can safely enjoy this unique attraction in the City of Lockport and I’d like to thank my colleagues in the Senate as well as in the Assembly for passing this important legislation.” “This legislation closes a blind spot in safety oversight. I'm proud to have worked with Senator Ortt, Assemblyman Morinello and my colleagues in the state legislature to pass this common-sense bipartisan bill to improve safety for consumers and operators along the Canal,” said Assemblyman Mike Norris. “Public safety is always priority number one. It is important to allow the suspension of an issued certificate of inspection if the operation poses a threat to public safety. This bill will create much safer conditions for passengers, vessel operators, and crew,” said Assemblyman Angello Morinello. The bill received wide support in both houses and now heads to the Governor’s office.

- If You Visit Niagara Falls, Do NOT Be These People
Niagara Falls, one of the world's most breathtaking natural wonders, attracts millions of visitors each year. While the majestic beauty of the falls is undoubtedly captivating, it is crucial to remember that safety should always be a top priority. Crossing barriers and venturing too close to the water's edge can have tragic consequences, leading to severe injury or even death. The immense power and force of Niagara Falls cannot be underestimated. The rushing waters, combined with the steep drop-offs, create an environment that is inherently dangerous. The barriers and warning signs placed strategically along the viewing areas are there for a reason – to protect visitors from harm. Ignoring these safety measures can have devastating consequences. Over the years, there have been several tragic incidents where individuals disregarded the warnings and paid the ultimate price. One such story is that of a young couple who ventured beyond the barriers to take a closer look at the falls. In a moment of misstep, they lost their footing and were swept away by the powerful currents. Their lives were tragically cut short, leaving behind grieving families and a stark reminder of the dangers that lie beyond the safety barriers. Another heart-wrenching tale involves a group of friends who thought it would be thrilling to venture closer to the edge for a daring photo opportunity. In their pursuit of an adrenaline rush, they ignored the warnings and crossed the barriers. Tragically, one of them slipped and fell into the churning waters below. Despite rescue efforts, the outcome was devastatingly fatal. The consequences of venturing too close to the edge are severe and irreversible. The powerful currents can easily sweep away even the strongest swimmers, and the steep drop-offs make it nearly impossible to escape once caught in the water. When visiting Niagara Falls, please remember the following safety guidelines: 1. Respect the barriers: Stay behind the designated safety barriers at all times. They are there to protect you from the dangers of the rushing waters. 2. Stay alert: Be mindful of your surroundings and the potential hazards. Slippery surfaces, strong winds, and unpredictable currents can pose significant risks. 3. Keep children close: Supervise children closely and ensure they understand the importance of staying away from the edge. 4. Follow instructions: Pay attention to any instructions or guidelines provided by park officials or tour guides. They are there to ensure your safety. 5. Capture memories safely: Take stunning photos from designated viewpoints and platforms. Do not risk your life or the lives of others for a photo opportunity. It is essential to understand that the barriers and warning signs are not meant to spoil the experience but rather to ensure the safety of visitors. Admiring the beauty of Niagara Falls from designated viewing areas provides an awe-inspiring experience while keeping you out of harm's way.
- MarineLand's Troubled Legacy: A Story of Animal Abuse and Legal Battles
MarineLand, once a beloved marine mammal park and a popular destination for tourists and families, has experienced a dramatic rise and fall over the last two decades. Since its establishment in 1963 by owner John Holer, MarineLand has captivated visitors with its diverse collection of marine animals including whales, dolphins, sea lions, and more. However, recent controversies and legal challenges have tarnished the park's reputation, leading to a legacy of infamy. MarineLand's journey to fame began with the introduction of orcas in the late 1960s with the notable performer Kandu becoming a star attraction. The park also boasted other captivating exhibits such as Beluga whales, sea lions, walruses, and even amusement park rides, drawing millions of visitors each year. The creation of the King Waldorf Stadium in 1975 further elevated MarineLand's status, accommodating up to 5,000 spectators. During its peak years in the 1990s and early 2000s, MarineLand was considered a must-visit destination for anyone exploring Ontario, attracting over 300,000 visitors annually. However, as the new century dawned, the park faced mounting public criticism and legal battles over allegations of mistreatment of its marine animals. Former animal trainer Phil Demers became a prominent voice in raising concerns about the welfare and living conditions of the animals at MarineLand. Activists joined the cause, protesting against the park's treatment of whales and dolphins. Accusations of animal abuse and mistreatment tarnished the park's image. In response to growing public outrage, Ontario introduced the Orca Ban in 2015 which prohibited the breeding and acquisition of killer whales in the province. Subsequently, the Canadian Parliament passed bill S-203, which banned the captivity of cetaceans altogether. These legislative actions dealt a severe blow to MarineLand's operations. Despite efforts to rehabilitate its reputation through the introduction of new exhibits, MarineLand struggled to regain public trust. By the end of the decade, the park had become a mere shadow of its former glory. In 2021, the Holer family, who still owned MarineLand, reached an agreement to sell the park to Antibes Land, a company based in France. However, the deal fell through due to disagreements over financial terms leading to the announcement of a temporary closure for the 2022 season. Currently, MarineLand remains open but with limited attractions leaving its future uncertain. As MarineLand navigates these challenging times, the park's management and stakeholders face the daunting task of revitalizing its image and addressing the concerns raised by animal welfare advocates. The fate of this once-iconic marine mammal park hangs in the balance, leaving many to wonder what lies ahead for MarineLand and its once-beloved marine inhabitants.

- Families, Lawmakers Demand Answers Niagara Falls Guard Unit Troops in Niger, Africa
Families and lawmakers from Western New York are putting pressure on the defense and state departments to provide updates on the status of Niagara Falls National Guard Unit troops deployed in Niger, Africa. The six-month deployment of the troops has been extended as the United States plans to withdraw its forces from the region by September. Members of the local Congressional delegation have expressed concerns about the difficult mission that Air National Guard soldiers from the Niagara Falls airbase are facing in Africa. The families of the troops are also worried about the extended deployment. Last fall, the 107th Attack Wing of the Air National Guard, based in Niagara Falls, deployed to the West African Republic of Niger. The mission was expected to last for six months and aimed to support the U.S. efforts in monitoring Al Qaeda and ISIS-linked terrorist camps in northern Africa. However, last summer, riots erupted in the capital city of Niger as military leaders seized power from the country's President. Subsequently, the military demanded that all U.S. troops leave two airbases in the country. This demand coincided with the arrival of Russian military forces. In response to the evolving situation, the Pentagon has ordered an extension of the 107th's mission. The withdrawal program for U.S. troops is now scheduled to be completed by September 15th. Concerned family members of the deployed troops have reached out to local news outlets and members of Congress. U.S. Senator Kirsten Gillibrand, who serves on the Senate's Armed Services Committee, has stated that her office is checking with the Pentagon's African Command to address the concerns raised by the families. While the African Command believes that everything is stable and well supplied, Senator Gillibrand intends to inquire further due to the families' worries. Representative Langworthy has sent a strongly worded letter to Defense Secretary Austin and Secretary of State Blinken, highlighting the concerns of the families. The letter also references the troubled 2021 U.S. withdrawal from Afghanistan, where U.S. soldiers lost their lives in a suicide bombing and military equipment was left behind. Langworthy emphasized the importance of staying vigilant and ensuring the safety and well-being of the troops. He stated, "We have requested immediate and comprehensive updates from the Administration to ensure that our troops are safe, well supplied, and informed of the situation. Our service members and their families deserve nothing less than transparency." Langworthy also expressed the goal of avoiding a repeat of the disastrous events in Afghanistan, which had severe consequences for U.S. troops and the entire region. As the situation in Niger continues to unfold, lawmakers and family members remain committed to holding the Biden Administration accountable and ensuring the safety of the deployed troops.

- $50.8 Million Restoration of Historic Hotel Niagara in Niagara Falls To Start Again (Maybe)
After facing pandemic-related financing challenges that caused a three-year delay, a Syracuse-based development firm is reviving its plan to renovate the iconic Hotel Niagara in Niagara Falls. Brine Wells Development, which has been working on the project for over seven years, aims to transform the century-old landmark into an upscale hotel while preserving its historic charm. However, the cost of the project has increased by 21%, now totaling $50.8 million. The restoration efforts will focus on the hotel's exterior, including the repair or replacement of decorative terra cotta, cleaning and polishing of stonework, and restoration of the decorative windows. The interior areas, such as the lobby, restaurant, ballroom, mezzanine, and meeting rooms, will also be restored to their original colors. Additionally, the guest rooms and the basement barbershop will undergo renovation. Once completed, the hotel will feature 160 guest rooms, a main ballroom, a secondary ballroom, a full-service restaurant, a sidewalk-facing lounge, an exterior patio, a rooftop lounge, and spaces for private dining and meetings. To support the restoration project, Brine Wells and its subsidiary, Hotel Niagara Development, are seeking $6.71 million in tax breaks from the Niagara County Industrial Development Agency. - Tops Supermarket Shooter Seeks Dismissal of Federal Case, Says Death Penalty Cruel and Unusual
Lawyers representing Payton Gendron, the shooter responsible for the tragic deaths at Tops Supermarket on Jefferson Avenue, are requesting a federal judge to dismiss the entire federal case against their client arguing that the death penalty, which is being sought by the federal government, is cruel and unusual punishment. In a court filing, Gendron's lawyers assert that the federal death penalty case is not in the public interest and is unnecessary to secure substantial justice. They point out that Gendron has already been sentenced to life in prison in New York State under hate crime statutes, making the federal case duplicative. The lawyers question the federal government's rationale for pursuing the prosecution, stating that it will only serve to delay the resolution of the matter for years, if not decades. The defense attorneys highlight that Gendron pleaded guilty to all charges in the state indictment and was subsequently sentenced to life in prison without parole plus 90 years. They argue that the State of New York has already demonstrated its commitment to prosecuting Gendron to the fullest extent and ensuring justice is served. They question the need for the federal government to intervene when the state has already taken appropriate action. Gendron meticulously planned his attack, specifically targeting a highly-populated Black neighborhood to maximize the impact of his actions. He drove from Conklin, New York to Buffalo and opened fire at Tops Friendly Market on Jefferson Avenue on May 14, 2022. He was apprehended by Buffalo police in the Tops parking lot on the same day. In November 2022, Gendron pleaded guilty to state charges and was sentenced to life without parole in February 2023. Now, at almost 21 years old, he remains in the Livingston County Jail as the federal case against him continues. The defense attorneys argue that Gendron should be excluded from the death penalty due to his age at the time of the shooting. They emphasize that the brain continues to develop into the early 20s, and executing individuals under the age of 21 goes against the evolving consensus and community standards endorsed by the Supreme Court. They cite a report by the United States Sentencing Commission which defines youthful offenders as individuals aged 25 or younger at the time of sentencing in the federal system. According to the defense, scientific evidence supports the notion that individuals under 21 should not be treated as fully developed adults and should be exempt from capital punishment. They point out that only a small number of states have young individuals on death row, reflecting a broader trend away from executing 18-year-olds. The defense lawyers explicitly state that individuals like Payton Gendron, who were 18 years old at the time of their charged capital offenses, should be treated differently under the Supreme Court's Eighth Amendment death-penalty jurisprudence. They argue that the ongoing brain development in individuals of this age results in lesser culpability, which is recognized in the country's laws and practices.
- Former New York Gov. Andrew Cuomo to Face Congressional Inquiry on Nursing Home Guidance
Former New York Governor Andrew Cuomo is set to appear before the House Select Subcommittee on the Coronavirus Pandemic to provide answers regarding his administration's nursing home guidance during the height of the 2020 pandemic. The inquiry aims to shed light on the policies implemented by Cuomo, which some claim had deadly consequences for New York's vulnerable population. Chairman Wenstrup expressed concerns over the former governor's decisions, stating, "Former New York Governor Andrew Cuomo implemented nursing home policies that had deadly consequences for New York's most vulnerable population. Not only did the former governor put the elderly in harm's way, but he also attempted to cover-up his failures by hiding the true nursing home death rate. It appears that politics, not medicine, was responsible for these decisions." The closed-door meeting, scheduled by the House Select Subcommittee, will provide an opportunity for Cuomo to explain the reasoning behind issuing a "must admit" pandemic nursing home guidance. The testimony of the former governor is seen as crucial in uncovering the circumstances that led to these policies and ensuring that such fatal mistakes are not repeated in the future. The Select Subcommittee has already interviewed several officials who were part of Cuomo's administration, including Dr. Howard Zucker, former Commissioner of the New York State Department of Health (NYSDOH), Dr. Elenor Adams, former Special Advisor to the Commissioner of the NYSDOH, Mr. Gareth Rhodes, former Deputy Superintendent of the New York State Department of Financial Services, Dr. Jim Malatras, former Advisor to the Governor, Ms. Beth Garvey, former Special Counsel to the Governor, and Ms. Linda Lacewell, former Superintendent of the New York State Department of Financial Services. Melissa DeRosa, the former Secretary to Governor Cuomo, is scheduled for an interview at a later date. Cuomo's spokesman dismissed the upcoming congressional appearance as a purely political move with no news value, highlighting that previous investigations by the Department of Justice, Congress, and the Manhattan District Attorney found no substantial evidence. The spokesman emphasized that similar policies were implemented in 10 other states, regardless of political affiliation, suggesting that any comprehensive review should consider a broader scope. As the inquiry unfolds, the focus remains on obtaining transparency and accountability from Cuomo regarding the nursing home guidance during the pandemic. The testimony of the former governor is expected to provide valuable insights into the decision-making process and address the concerns of the families who lost loved ones in New York nursing homes.
