- Lockport Alderman Exposed Himself to Children Several Times, Court Docs Allege
City of Lockport Alderman Mark Devine (R) appeared before a judge on Monday to face allegations of harassment. The accusations against Devine are bizarre as he is accused of urinating outside his home in front of neighborhood children, exposing himself several times over the course of two years. Devine declined to comment when leaving court. Devine is currently facing two counts of harassment in the second degree, which is a violation in New York State - this means it is not a criminal offense. The case stems from an incident that occurred on April 11 when a neighbor of Devine reported to the police that the alderman had allegedly urinated outside his home within the view of children from a neighboring residence. According to statements provided by Devine's neighbors to the police, this is not an isolated incident. Witnesses claim to have seen Devine urinating outside his home on multiple occasions in the past. One incident occurred while a neighbor was buckling her daughter into a car. Another incident took place with children just 10 feet away. Statements further allege that Devine has been observed generally exposing himself and that this type of behavior has been ongoing for at least two years. "I would like to pursue charges because I feel this is inappropriate and disgusting," one neighbor expressed to the police. "I feel Devine should know better." The case against Devine has been adjourned until July 1, allowing for further investigation and legal proceedings. Thus far, the court docs and several signed statements from witnesses allege Lockport Alderman Exposed Himself to Children Several Times. As the case unfolds, more information will be provided.
- Male Stages Bizarre Attempted Break-in to Dollar Tree to Reach Female Manager
Niagara Falls Police responded to Dollar Tree on Portage Road around 10:00am on May 29th after reports of a bizarre attempted break-in to reach the female manager. Upon arrival, police spoke to the female store manager who stated the entire incident was captured on video. This is what the footage showed: At 6:50am on May 27th, an unknown male carrying a duffle bag could be observed walking back and forth while he peered into the store for several minutes. He then proceeded to wait outside of the store until the female store manager pulled into the parking lot. The unknown male watched the store manager exit her vehicle, unlock the store door, enter the store, lock the door behind her, and turn off the alarm. He then waited for her to enter the office, at which time he put his duffle bag down, took a wrench out of it and took the handle off the store door by loosening the bolts. The store manager then started walking towards the front of the store at which time he walks away from the door. The store manager then walked towards the back of the store and the unknown male went back to the door and used another tool to wedge in between the store doors to pry it open. As the unknown male was struggling to open the door, the store manager walked from the back of the store to the front again causing him to walk away. Once she returned to the back of the store the male tried to pry the door open again, but he was unsuccessful. The store manager stated she observed the unknown male standing outside of the store pacing back and forth but did not think anything of it because it is common for people to walk around the parking lot. The manager also stated she did not call police right away because she had to wait to observe the video footage and put in a work order for the door. It is unknown what the male would have done if he successfully gained entry to the store with only the female manager inside. No further information is available at this time.

As Allen continued his story, it became clear that this was no ordinary rip. "I took two more steps, and I had the cargo pockets, so I reached down like, 'what do I have in here?' The falls, consisting of three waterfalls straddling the border Canada and the USA, are the main draw for visitors. However, islands scattered around Niagara Falls offer their own unique charm and are well worth exploring. Among these hidden gems are Green Island, Goat Island, and the Three Sisters Islands. Goat Island, located in the heart of Niagara Falls between the American Falls and Horseshoe Falls, provides visitors with an up-close and personal view of the roaring waters. From these islands visitors can enjoy breathtaking, unobstructed views of the upper rapids as the water rushes towards the falls. It's a truly awe-inspiring sight that shouldn't be missed. It's a perfect spot to escape the crowds and take in the beauty of the surroundings. Niagara Falls is also home to other lesser-known islands, each with its own unique appeal. - Love Canal Site: A Promising Future for Renewable Energy in New York State
In a remarkable turn of events, the site of the worst environmental disaster involving chemical wastes in U.S. history - Love Canal - may soon be transformed into a large-scale, eco-friendly, solar renewable energy project. The New York State Energy Research and Development Authority (NYSERDA) has initiated the process to determine the feasibility of reclaiming and developing the land that was once the infamous Love Canal landfill, owned by the Hooker Chemical Company, into the Vincent Welch Build-Ready Solar project. Situated on approximately 16 acres of land owned by the city of Niagara Falls, the proposed solar farm area is located south of Colvin Boulevard, north of the LaSalle Expressway, and between 93rd and 95th streets. Previously, this land served as the site for the Griffin Housing Development and the notorious Love Canal. Gillian D. Black, the director of NYSERDA's Build-Ready program, explained that the project is currently in its early exploratory phase. The Build-Ready program aims to advance large-scale renewable energy projects on challenging sites that the private sector has not yet developed. These sites include brownfields, landfills, existing or abandoned commercial and industrial areas, dormant electric generating sites, former mines, closed prisons, and parking lots. Once a site is identified for redevelopment, the Build-Ready program takes charge of project design, engineering, permitting, electrical grid interconnection review, and the development of a host community benefit package. Acting as a private developer, NYSERDA negotiates PILOT (payment in lieu of taxes) agreements and community benefit agreements to bring these difficult sites back into productive use for renewable energy generation, without competing with the private sector. After the Build-Ready sites have been de-risked, the program's goal is to involve independent power producers (IPPs), private sector energy companies, in the final development of the projects. NYSERDA plans to auction off the sites through an open and competitive request for proposal (RFP) process for construction and operation. The Love Canal site was initially proposed to NYSERDA by the Mayor Robert Restaino's administration, and ongoing discussions have taken place between NYSERDA and the mayor's staff regarding the project. The initial plan for the Love Canal site involves implementing a ballasted solar electric system. This system utilizes concrete weights to anchor the framing that holds the solar panels, eliminating the need for posts or post holes that would penetrate the ground. Such a system is well-suited for contaminated properties like Love Canal where the caps should not be compromised. To ensure successful integration with the local power grid, the Build-Ready program has engaged in discussions with representatives from National Grid. While this process may take some time, there is optimism regarding the interconnectivity of the proposed solar farm. If NYSERDA determines the project's viability, negotiations will commence to lease the land from the city, and the regulatory approval process will begin. Additionally, NYSERDA aims to create a host community benefits package which may include discounted electricity for local residents, fostering a win-win situation for all stakeholders involved. The potential transformation of the Love Canal site into a thriving renewable energy project showcases New York State's commitment to sustainable development and environmental remediation. By repurposing challenging sites for renewable energy generation, NYSERDA and the Build-Ready program are paving the way for a greener future while revitalizing communities and promoting economic growth.

- Family of 6-year-old boy Ra'Mari Killed in North Tonawanda Train Crash Hires Law Firm
The family of a 6-year-old boy who tragically lost his life in a train crash in North Tonawanda has sought legal representation, retaining the law firm of Schiffmacher Cinelli Adoff LLP. Ra'Mari Geldart, along with David McGinn, 69, and Olive Geldart, 66, were killed when their pickup truck was struck by an Amtrak passenger train on May 17th. The incident occurred as the truck stopped on the train tracks while the railroad gates closed around them after turning off River Road onto Felton Street. Authorities are still investigating why the truck came to a halt on the tracks, but they have confirmed that a traffic stop was occurring on the other side of the tracks. Todd Schiffmacher, one of the attorneys representing the sole legal guardian and father, expressed concerns about the conduct of all parties involved in controlling the Felton Street railroad crossing, except for Ra'Mari. He emphasized that Ra'Mari was an innocent victim in this tragic accident, and his family has been deeply affected by his untimely death. The legal team is determined to uncover the cause of the accident and work towards preventing similar incidents in the community. "The firm has been asked to investigate the cause of the fatal railroad accident and to preserve Ra'Mari's legacy by holding the responsible parties accountable for their actions," said Schiffmacher. After reviewing the facts thus far, legal scholars believe liability might exist with the law enforcement agency who had conducted a vehicle and traffic stop close to the railroad tracks. There is a duty to create a safe environment for motorists when engaging in a V&T stop. It has been alleged that perhaps the truck driver felt he could not move around the police stop. Questions have also been raised about how law enforcement did not see the truck sitting on the tracks having been in such close proximity. We wrote recently about the dangers of traffic stops during saturation patrols (https://www.niagaraaction.com/fatal-north-tonawanda-train-crash-underscores-risks-of-traffic-stops-during-saturation-patrols). In a situation such as this where law enforcement agencies are operating in a municipality they are not familar with, unforseen events can arise. As more information comes out, we will share it with you. According to records maintained by the Federal Railroad Administration, North Tonawanda has experienced 28 train-vehicle accidents since 1976, with 6 of them resulting in fatalities and 6 causing injuries.

- Fatal North Tonawanda Train Crash Underscores Risks of Traffic Stops During Saturation Patrols
On May 17, police officers in North Tonawanda embarked on a saturation patrol, unaware of the devastating events that would unfold later that evening. A fatal train crash occurred when a pickup truck became trapped on the tracks as the railroad gates closed. The incident claimed the lives of David McMinn, Olive Geldart, and 6-year-old Ra'Mari Geldart, serving as a stark reminder of the potential dangers faced by both motorists and law enforcement during traffic stops. North Tonawanda Police Captain Rob Frank acknowledged that while the department does not have specific training for safely conducting saturation patrols, officers are trained to handle various situations encountered during such operations. Saturation patrols involve a large number of officers simultaneously patrolling a designated area, often in collaboration with other departments, with the aim of targeting specific crimes or issues. On the night of the tragic incident, North Tonawanda officers were working in conjunction with the Lewiston and Lockport police departments, as well as the Niagara County Sheriff's Office, to locate individuals with outstanding warrants. As the investigation into the crash is ongoing, Captain Frank could not provide extensive details about the events leading up to the collision. However, he confirmed that the Lewiston Police Department's canine unit, which had made a stop on the east side of the railroad tracks, was present on the road. Despite this, Fran said that McMinn, the pickup truck driver, had sufficient space to maneuver beyond the tracks. John Bandler, a former New York State trooper and adjunct professor at John Jay College, emphasized that vehicle stops during saturation patrols and other unplanned locations can potentially create unsafe situations. Anita Butera, director of Canisius University's Criminal Justice program, echoed this sentiment, stating that law enforcement should anticipate unsafe conditions during operations like saturation patrols and checkpoints. She emphasized the importance of directing confused or impatient drivers to ensure their safety. The primary concern, Butera emphasized, is to ensure the safety of all individuals involved. With saturation patrols and checkpoint operations, traffic congestion should be expected, and measures should be taken to mitigate any potential dangers. The tragic train crash in North Tonawanda serves as a somber reminder of the risks inherent in traffic stops during saturation patrols. Law enforcement agencies must continue to prioritize safety and implement appropriate measures to protect both officers and motorists during these operations.

- Analyzing the Market for a new Niagara Falls Event Center
By: Ken Cosentino Live entertainment experts such as Christian Printup have voiced their opinions in opposition of Mayor Restaino’s proposed event center in Niagara Falls, NY. One of their key arguments as to whether or not this project is even feasible involves the saturated market for live events in immediate proximity to our community. The City of Niagara Falls already has three event centers, two of which are owned by the Seneca Nation of Indians. The first is the Bear’s Den which seats 440 people and is located inside of the Seneca Niagara Casino. The second is the Seneca Niagara Event Center which seats 2,500. Mayor Restaino claims that the Senecas are interested in partnering up with the city and supporting his proposed event center, however Mayor Restaino has been the lone voice on this subject. There has been no evidence in recent memory of this alleged support from the Senecas. Why would the Seneca Nation want to support their entertainment competition in a city where they’re already the only game in town? The third event center in Niagara Falls is located inside of the Niagara Arts and Cultural Center. The Legacy Theatre seats 900 and is gearing up for a $1 million upgrade. Up until recently, there was a fourth event center in Niagara Falls; Rapids Theater, which has a capacity of 800 people. Unfortunately, Rapids Theater recently went belly up after suffering financial struggles following the pandemic. This should serve as a warning sign to supporters of Restaino’s grand illusions. The outdoor amphitheater at ArtPark is a 17 minute drive from the City of Niagara Falls and it seats 2,400 people, with general admission for almost 20,000. It also has the luxury of being outdoors which most people prefer over indoor concerts in the summertime. Right across the border in Niagara Falls, Ontario is the Fallsview Casino and Resort, which boasts two event centers: The OLG stage seats 5,000 and the Avalon Theatre seats 1,500 people. This venue has already proven its A-list purchasing power with acts such as Billy Joel and Carlos Santana. 32 minutes away, in St. Catharines, Ontario is the Meridian Centre which seats 5,300 and hosts the OHL Niagara IceDogs. One hour away, in Hamilton, Ontario; is the FirstOntario Centre which seats 19,000 people and still books first class entertainment. The Historic [West Herr] Riviera Theatre in North Tonawanda seats 1,100 people and is a 20 minute drive from Niagara Falls. The University at Buffalo Alumni Arena is a 25 minute drive from our community and it seats 6,500 people. Earlier this month, Multi-Grammy and Oscar winner Jon Batiste performed here. KeyBank Center is approximately the same distance away and it seats 19,200; is the home of the NHL Buffalo Sabres as well as the Mill back-to-back championship team the Buffalo Bandits; and it hosts top tier entertainment acts. The Shea’s Buffalo Theatre seats 3,019 and is 28 minutes from Niagara Falls. Shea’s also has the Smith Theatre which seats 200 and the 710 Theatre which seats 558. Shea’s hosts Broadway performances and musical acts. Lastly, the Amphitheater at Darien Lake is 50 minutes away and seats 21,600 people; this venue features summertime chart-topping acts, drawing from all over WNY. All of these event centers are already well established. They have all hosted world class acts and performers. Longevity is important in the live entertainment business, especially when it comes to attracting new talent. Whether it’s a live concert, sports entertainment, stand-up comedy or a magic show - legitimate acts and their bookers scrutinize venues very carefully. Mayor Restaino’s proposed event center lacks committed partners to anchor the center; which is necessary in order to generate consistent daily revenue to finance the facility. It also lacks the type of clean and safe surrounding environment that patrons and performers both expect from a top-notch venue. In my opinion, Mayor Restaino should spend his entire term focusing on fixing our crime and poverty. These two issues go hand-in-hand, and pose a critical logistics problem for his dream of having an event center. Simply stated, he put the cart before the horse. Take a look at Rapids Theater which struggled in its attempt to revitalize Main Street. We have to clean the pond before we start inviting big fish to come and swim in it. Why would any legitimate show or team choose to perform at an unproven venue in a crime-ridden, impoverished city when they have so many better options - all within a one hour drive from our natural wonder? City Council has approved Mayor Restaino’s recommendation of a “market analysis and feasibility study”, to be conducted by Sports Facilities Advisory LLC, a Florida based firm. Given the facts, it will be interesting to see what Restaino’s feasibility study reveals about both the site selection and the actual feasibility of his proposed event center. Will the results of the survey reflect the complete absence of anchor tenants and the stiff competition from established entertainment venues in the area? Lastly, the firm conducting the feasibility study also offers facility management services. It behooves our City Council to keep an eye on whoever is awarded the operations contract, should the event center ever become a reality.
- Argument Over a Puppy Gets Violent in Niagara Falls, Leads to Bloodshed
Niagara Falls Police responded to the 2200 block of 15th Street around 7:30pm on May 21st after an assault with a dangerous weapon causing bloodshed - all stemming from an argument over a puppy. Upon arrival, police observed blood on the sidewalk and on a shovel that was laying on the ground. The complainant said she was outside with her boyfriend when his friends, along with a random male, came over. She said they were on the sidewalk arguing about a puppy one of them was holding. The man they called “Florida” picked up a shovel that was on the ground and looked like he was going to hit someone with it. She stated he dropped it on the ground and then took out a razor, swung it at another male causing cuts on his face and back. The suspect “Florida” fled on foot after 911 was called. Law enforcement was able to quickly ascertain Florida’s identity through the IMPACT system using the nickname. The male found in the system matched the physical description given of the suspect, and he was located shortly thereafter by police. He was placed under arrest and transported to police headquarters.
- Niagara Falls' Cave of the Winds: Torn Down and Reborn Every Year
The Cave of the Winds, an exhilarating attraction at Niagara Falls State Park, offers more than just breathtaking views of the American, Bridal Veil and Horseshoe Falls. This thrilling tourist attractions takes visitors as close to the falls as possible, providing a soaking, gusty adventure into the roar of Niagara. The attraction consists of wooden decks that are built on rocks up against the Niagara Gorge. The Cave of the Winds is known for its "Hurricane Deck, which allows visitors to stand directly under Niagara Falls. With winds reaching over 68 miles per hour while endless water pours over your entire body, this deck truly lives up to its name. Originally named after a natural cave discovered in 1834 behind Bridal Veil Falls, the Cave of the Winds stood approximately 130 feet high, 100 feet wide, and 30 feet deep. However, due to safety concerns, the cave was dynamited shut in 1954. Niagara Falls experiences harsh winter weather, making it susceptible to icy conditions and high winds. To ensure visitor safety and protect the deck from ice formations, most of the attraction's wooden walkways are dismantled every November. Piece by piece, the wooden deck is carefully removed before the winter onslaught begins. As the weather warms and the icy danger subsides, usually around May, the deck is meticulously reconstructed for the upcoming summer tourist season. The annual construction and demolition of the Cave of the Winds have become a local tradition spanning decades. It is a testament to the resilience of this man-made marvel standing strong against the sheer power of nature. This impressive feat adds to the allure of the Cave of the Winds, attracting thrill-seeking tourists from around the world. Even during the winter months, the Cave of the Winds remains accessible. A walking area that does not require replacement allows visitors to stand close to the American and Bridal Veil Falls, immersing themselves in the winter wonderland of ice, snow, and misty chills. When you visit this marvel, remember that it is not just a series of decks but a symbol of human resilience. It stands tall and strong, staring down at one of nature's most ferocious sights, only to be torn down and reborn every year. So prepare yourself with windbreaker ponchos and specially designed sandals as you brave the tropical storm-like conditions at the Cave of the Winds. Experience the gushing sprays and thunderous roars of Niagara up close, creating memories that will last a lifetime.
- The Force of Niagara Falls: Could it Level a House?
Niagara Falls, a captivating wonder of nature, has mesmerized tourists for centuries. Among its three waterfalls, the Horseshoe Falls stands out for its immense water volume and flow rate - both of which are the post powerful in the world. This raises an intriguing question: would the power of Niagara Falls (specifically the Horseshoe Falls) be potent enough to crush or level a residential house? The Horseshoe Falls v. an Average Residential House As a general statement, a typical house is not designed to withstand extreme forces of nature such as a massive earthquake, a tornado, or even a category 5 hurricane. But what about the Horseshoe Falls? The Horseshoe Falls, responsible for over 90% of Niagara Falls' flow, plunges approximately 185 feet and spans 2,600 feet wide. During peak times, nearly 6 million cubic feet of water, equivalent to 50 Olympic-sized swimming pools, cascades down the falls every minute. This represents an immeasurable amount of force. To put it into perspective, the weight of water from the Horseshoe Falls hitting a house in just one minute would be comparable to about 50,000 large SUVs. Additionally, water exerts significant pressure due to its high density and incompressibility. At 185 feet, the pressure would be more than seven times greater than atmospheric pressure (a significant amount). Could the Horseshoe Falls Crush a House? Considering these figures and the fact that most residential homes are not designed to withstand extreme external pressures, the outcome of this hypothetical situation could not be more clear. The Horseshoe Falls is not only likely, but CERTAIN, to crush a home (and any sized home at that). The substantial pressure and impact of the water would rip apart a house located beneath the Horseshoe Falls to the point nothing would be left. Complete destruction. Sadly, no experiment can test this hypothesis (although let's face it that would be cool). The numbers are clear though - the Horseshoe Falls' force is too strong and the resistance a house would present too small. It highlight not only the astonishing might of the falls but also its capacity for devastation when their fury is unleashed.
- Leandra's Law Arrest of 20-year-old from Niagara Falls: Two Infant Children in the Car
On May 26th, 2024 at 1600 hours, Deputy Ross observed a vehicle traveling on Military Road. The vehicle made abrupt lane changes multiple times while failing to signal. During the course of the subsequent Traffic Stop, Deputy Ross observed signs of drug impairment from the operator, a 20-year- old-male from the City of Niagara Falls. There was a 1-year-old child and an 8-month-old child in the vehicle, both in improper child restraints. As the result of the investigation, the male was arrested for Driving while Impaired by Drugs. He was transported to NCSO where he was evaluated by a Drug Recognition Expert (DRE). In addition to DWI-Drugs, the male was charged with: Aggravated Driving While Intoxicated – Leandra’s Law (Felony), two counts of Endangering the Welfare of a Child (Misdemeanor), and multiple VTL violations which include: improper child restraint, improper turn signal, and moving from lane unsafely.
